Upcycling: mancato esaurimento del marchio
Il Tribunale di Parigi, con decisione n. 25/00621, ha affermato, tra l’altro, che la realizzazione e commercializzazione di nuovi prodotti (gioielli ed accessori) mediante l’utilizzo di bottoni, fibbie e ciondoli contraddistinti da marchi altrui e prelevati da capi di abbigliamento ed accessori già commercializzati (c.d. upcycling), costituisce violazione dei diritti esclusivi relativi ai predetti marchi; in tal caso, non opera il principio dell’esaurimento del marchio, in quanto tale principio non consente la realizzazione e commercializzazione di nuovi prodotti, costituiti da elementi contraddistinti da marchi altrui e che in precedenza erano parti di altri prodotti.
Upcycling: no trademark exhaustion
The Court of Paris, with decision no. 25/00621, amongst other things, stated that the manufacturing and marketing of new products (jewellery and accessories) using buttons, buckles and pendants bearing a third party trademark and taken from items of clothing and accessories already on the market (so called upcycling) constitutes an infringement of the exclusive rights relating to the trademark; in such cases, the principle of trademark exhaustion does not apply, as that principle does not allow the manufacturing and marketing of new products consisting of elements bearing a third party trademark, which was previously part of other products.
