MINOR ISSUE CASE

The recent circular of the Italian Ministry of the Interior of October 2024 concerning the new interpretative lines indicated by recent decisions of the Court of Cassation about recognition of Italian citizenship iure sanguinis has established that

“ following the voluntary naturalisation (during the minor age of the “bipolide” child at birth) of the parent cohabiting with him, the lines of transmission are to be considered interrupted in the case of that ascendant has not reacquired Italian nationality once he has come of age. In such cases, in fact, the failure to re-acquire Italian nationality prevents the capacity to transmit our status civitatis to their line of descent”

If the client believes that he falls into one of the ‘minor issue cases’ and therefore thinks that he cannot obtain Italian citizenship, our law firm can assess his case to check whether he really falls into such cases or whether there are alternatives, under Italian law, that would allow him to obtain Italian citizenship administratively or judicially.

On disloyalty in the custody of documents (Delito de infidelidad en la custodia de documentos)

The Spanish Criminal Code establishes that:

(Article 413)

“An authority or public officer who knowingly steals, destroys, full or partially cancels or conceals documents the custody whereof is entrusted to him due to his office, shall incur a prison sentence of one to four years, a fine for seven to twenty- four months, and special barring from public employment and office for a term of three to six years.”

DIRITTO PENALE ITALIANO-DERECHO PENAL ITALIANO-ITALIAN CRIMINAL LAW
Sentenza della Corte Suprema di Cassazione- Sesta Sezione Penale depositata il 30/01/2025
Nella sentenza n.3892 depositata il 30/01/2025 della Corte Suprema di Cassazione- Sesta Sezione Penale è stato affermato quanto segue:
“ritiene questo Collegio che sussista l’interesse del pubblico ministero a impugnare con il ricorso per cassazione la mancata convalida del provvedimento di allontanamento di urgenza dall’abitazione familiare, anche nel caso in cui non vi sia stata una coeva richiesta di applicazione di una misura cautelare nei confronti dell’indagato, poiché il riconoscimento dell’interesse della pubblica accusa è evincibile dalla lettura dell’art. 568, comma 4, cod. proc. pen., alla luce del parametro fissato dall’art. 111 Cost., dunque di una regula iuris che vuole che vi sia sempre una necessaria verifica giurisdizionale sulla legittimità di un provvedimento che, sia pure con effetti più limitati rispetto a quelli prodotti dall’arresto e dal fermo, incide limitandola sulla libertà personale.”
e nella medesima sentenza è stato altresì affermato che
“che la misura precautelare dell’allontanamento d’urgenza dalla casa familiare adottata dal pubblico ministero ai sensi dell’art. 384-bis, comma 2-bis cod. proc. pen. costituisce un provvedimento di natura giudiziaria e che il giudice della convalida, è tenuto a compiere, in esito al contraddittorio delle parti e sulla base degli elementi acquisiti nel corso dell’udienza di convalida, una verifica sostanziale sulla sussistenza dei gravi indizi di colpevolezza e sul pericolo di reiterazione di condotte che pongano in grave e attuale pericolo la vita o l’integrità fisica della persona offesa.”
