As many of you know, yesterday a crucial hearing took place concerning Italian citizenship by descent. Today, the Constitutional Court issued a brief indicating that there are no grounds to consider Article 3-bis unconstitutional, nor to refer the case to the European Court. While the final ruling is still forthcoming, it appears likely that the case will be rejected.

However, there is another hearing scheduled for June 9th on the same matter. We are evaluating whether any avenues remain open in relation to this upcoming hearing. At this stage, we do not have the full decision detailing the Court’s reasoning, which will be crucial to assess next steps.

We will provide further updates as we consult with other legal counsel involved and as we gather additional information, whether formally or informally.

𝗜𝗠𝗣𝗢𝗥𝗧𝗔𝗡𝗧 𝗨𝗣𝗗𝗔𝗧𝗘 – 𝗗𝗲𝗮𝗱𝗹𝗶𝗻𝗲 𝗘𝘅𝘁𝗲𝗻𝗱𝗲𝗱 𝘁𝗼 𝗠𝗮𝘆 𝟯𝟭, 𝟮𝟬𝟮𝟵

The deadline to submit the declaration for minor children born before March 28, 2025 has been extended from May 31, 2026 to 𝗠𝗮𝘆 𝟯𝟭, 𝟮𝟬𝟮𝟵.

The extension was introduced by 𝗟𝗮𝘄 𝗡𝗼. 𝟮𝟲 𝗼𝗳 𝟮𝟳 𝗙𝗲𝗯𝗿𝘂𝗮𝗿𝘆 𝟮𝟬𝟮𝟲, converting 𝗗𝗲𝗰𝗿𝗲𝗲-𝗟𝗮𝘄 𝗡𝗼. 𝟮𝟬𝟬 𝗼𝗳 𝟯𝟭 𝗗𝗲𝗰𝗲𝗺𝗯𝗲𝗿 𝟮𝟬𝟮𝟱 (“𝗠𝗶𝗹𝗹𝗲𝗽𝗿𝗼𝗿𝗼𝗴𝗵𝗲”), in force since March 1, 2026.

There is no longer any pressure to file within the previously established timeframe.

Citizenship obtained through the declaration (“benefit of law”) is legally different from citizenship by descent and is 𝗻𝗼𝘁 𝗮𝘂𝘁𝗼𝗺𝗮𝘁𝗶𝗰𝗮𝗹𝗹𝘆 𝘁𝗿𝗮𝗻𝘀𝗺𝗶𝘀𝘀𝗶𝗯𝗹𝗲 𝘁𝗼 𝗳𝘂𝘁𝘂𝗿𝗲 𝗴𝗲𝗻𝗲𝗿𝗮𝘁𝗶𝗼𝗻𝘀, except under strict residency requirements. Clients should wait for the 𝗖𝗼𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗶𝗼𝗻𝗮𝗹 𝗖𝗼𝘂𝗿𝘁’𝘀 𝗽𝗲𝗻𝗱𝗶𝗻𝗴 𝗱𝗲𝗰𝗶𝘀𝗶𝗼𝗻 on the constitutionality of 𝗔𝗿𝘁𝗶𝗰𝗹𝗲 𝟭 𝗼𝗳 𝗗𝗲𝗰𝗿𝗲𝗲-𝗟𝗮𝘄 𝗡𝗼. 𝟯𝟲/𝟮𝟬𝟮𝟱 (𝗰𝗼𝗻𝘃𝗲𝗿𝘁𝗲𝗱 𝗶𝗻𝘁𝗼 𝗟𝗮𝘄 𝗡𝗼. 𝟳𝟰/𝟮𝟬𝟮𝟱), which introduced the new limitations on citizenship by descent. The decision is expected before this summer.
