قرار مفصلي من مجلس الدولة يعيد الأمور إلى نصابها القانوني
في خطوة تعالج تطبيقًا خاطئًا استمر لسنوات، حسم مجلس الدولة الجدل حول تفسير المادة (4) من قانون تنظيم الوكالات التجارية رقم 79 لسنة 2017، مؤكدًا أن الشرط المتعلق بعراقية الملكية يُطبّق فقط على الشركة طالبة الإجازة، ولا يمتد إلى مساهمي الشركات المالكة لها.

يُعد هذا القرار انتصارًا لمبادئ:

حرية النشاط الاقتصادي

المساواة في المعاملة التجارية

دعم بيئة الأعمال وتشجيع الاستثمار المحلي

القرار يفتح الباب أمام مئات الشركات العراقية التي كانت تُمنع من تسجيل وكالاتها التجارية رغم استيفائها للشروط القانونية.

Landmark Decision by the State Council Restores Legal Clarity
In a decisive move that corrects a long-standing misinterpretation, the Iraqi State Council clarified Article (4) of the Commercial Agency Law No. 79 of 2017, confirming that the requirement for Iraqi ownership applies only to the company applying for the agency license and does not extend to shareholders of its parent companies.
