Who really gets to choose India’s Election Commissioners? 👀

A 2023 law changed the selection panel — replacing the Chief Justice of India with a Union Cabinet Minister nominated by the Prime Minister. Under the law, the panel now consists of the PM, Leader of Opposition in Lok Sabha, and a PM-nominated Cabinet Minister.

Now, that change is facing a major constitutional test. On 23 September 2026, two Supreme Court judges differed on whether the challenge required consideration by a Constitution Bench, and the matter was placed before the CJI for constitution of an appropriate Constitution Bench.
