Before you turn your business into a franchise, there’s one question worth answering:

Is your brand legally ready to scale?

Franchising isn’t only about replicating operations across locations. Your brand name, logo and other distinctive elements can become central to the value you’re allowing others to use.

That makes IP protection an important part of your expansion strategy.

A growing franchise network means more people using your brand, more customer-facing touchpoints, and potentially more room for disputes if ownership and permitted use aren’t properly addressed.

So, before you start adding franchise outlets, make sure the foundation protecting your brand is in place.

Build. Protect. Scale.

What does Intellectual Property actually protect?

You build a brand. You create original work. You develop a distinctive design.

But what exactly protects each of these?

A trademark can protect distinctive brand identifiers such as names, logos and other marks used in relation to goods or services.

Copyright protects original creative works, including literary, artistic, musical and other forms of expression.

Design protection concerns the visual features and appearance of a product, subject to the requirements of Designs Act, 2000.

So, does IP awareness matter?

Absolutely. Understanding the rights associated with what you create can help you make more informed decisions about your intellectual property.

At cRadle and bAr, our practice areas include:
Trademarks | Copyrights | Designs

Can someone else trademark your brand name even if you already own the domain?

Yes, owning a domain name does not automatically give you trademark rights over the brand. A domain mainly gives you control over a web address, while trademark law deals with protecting a brand name, logo, or other mark in relation to specific goods or services. In India, trademark registration can provide important statutory protection, while prior use and passing-off rights can also become relevant depending on the circumstances.

So before you spend heavily on your website, packaging, advertising, Instagram presence, and branding, check the trademark position of your name. Buying the domain first may secure your online address, but it does not necessarily secure the brand itself. A proper trademark search and timely filing can help reduce the risk of expensive rebranding or legal disputes later.

Would you check the domain first or the trademark first?

Most founders focus on building a brand.
Almost none think about keeping it.

Ownership isn’t permanent, it’s something you maintain.

Most founders make this mistake 🚫
They “Google” their brand name… and think it’s safe.

It’s not.

Trademark rejection doesn’t care about Google results.
It checks legal ownership - including similar sounding names.

Avoid costly rebranding later.

📌 Always search on IP India + check the correct class before finalizing your brand.

Your trademark isn’t weak…
your filing might be.

One wrong class = zero legal protection.

Don’t let a small mistake cost your entire brand. Choose your trademark class wisely.
