Legal Aid Clinic has been a part of JGLS since its inception in 2009. Clinic exists with the sole aim of bridging the gap between what law promises to offer and the actual reality of law. It follows the model of good governance through citizen participation, which believes that good governance will come about only when citizens at all levels of our democracy effectively participate. The clinical l

egal education seeks to impart practical knowledge of law to students. The aim of starting the clinic was not only to bring future lawyers face to face with the harsh realities of law, but also by giving ourselves the opportunity to use and implement the law even before entering the professional world. Since 2009, the members of the society have engaged effectively with the rural communities by building a rapport with the communities, by understanding their concerns, after which they are connected to the district authorities, through the processes of law. This process engages communities on a weekly basis, organizing conferences, conclaves, interventions within our surroundings and unique creative methods (Eg: theatre performances).

The Members of the Legal Aid Clinic wrote to NHRC to seek their suo moto cognizance of the demolition of Sarai Kale Khan Night Shelter carried out on 15th February.

The demolition by Delhi Development Authority was undertaken upon recommendation of Deputy Commissioner of Police (South East District) who labelled the Shelter a “subject to crime”, finding it essential to be demolished before the G20 Summit. The Night Shelter has the capacity to house 150 homeless residents, and we urge that the displaced persons due to the hastened demolition be covered under the Pradhan Mantri Gramin Awas Yojna.

The deployment of barricades and police personnel during the pre-poned demolition without any Notice, sheds light on how the Night Shelter dwellers have been treated as “secondary”  citizens. The illegal displacement of the homeless has proven that the destitute continue to suffer without shelters.

The demolition is an explicit display of authorities abusing their power to demolish structures without following the law i.e. Delhi Urban Shelter Improvement Act and its welfare mechanisms existing for housing security of the homeless.

The members of the Legal Aid Clinic JGLS wrote to the National Human Rights Commission to seek their suo Moto cognizance of the demolition of the night shelter at Sarai Kale Khan, Near Bus Terminal Pota Cabin No. 1 (Jamuna Side). This demolition took under the orders of the Delhi Urban Shelter Improvement Board (DUSIB) on 15th February 2023. The concerned night shelter in question is built by the Delhi Urban Shelter Improvement Act with the capacity to house 150 homeless residents and we urge that the homeless and the persons displaced due to the demolition can be provided some form of housing security. The Night Shelter’s illegal demolition sheds light on the authorities abusing their power to demolish structures without following the law and its welfare mechanism existing for the housing security of the homeless.

Solidarity Statement on Hathras Incident

We, the students of Jindal Legal Aid Clinic, express our concern and condemnation for the incidents of caste and gender-based violence in the country and the State’s hostile and repressive attitude in dealing with such cases.

This statement has been sparked by the particular incident in Hathras, Uttar Pradesh, involving the brutal gang r**e of a 19-year-old Dalit girl by Thakur men, leading to grave injuries. She succumbed to the horrifying injuries inflicted on her at the Safdarjung Hospital where she was admitted in a very critical condition. Owing to her critical condition, the administration should have shifted her to Delhi for immediate treatment.

The manner in which the UP Police has behaved reveals how it blatantly supports upper-caste interests. We condemn the fact that the police did not register an FIR for around 4-5 days. The way in which Manisha Valmiki’s family was even denied the basic dignity of cremating their daughter’s body is atrocious and deplorable. The violence inflicted by the police personnel on the numerous protests and people wishing to meet the victim’s family reveals their active involvement and support for the perpetrators.

Inlight of evident intimidation by the upper caste groups, especially the Thakurs, we urge immediate Y level protection to be given to the family of the victim to ensure their safety. Stringent action should be taken against the police personnel who refused to file an FIR and also against those responsible for the cruel act of forcible cremation of the victim. Moreover, it is necessary for an independent judicial probe to carry out the investigation and proceedings of this case to ensure a fair and just decision.

We acknowledge our privilege as students of an elite private university in the country and as members of upper-caste, upper-class communities, and/or male members of society. We vow to be allies in the struggle for justice and the annihilation of such social inequalities.

We extend our solidarity to all the Dalit groups and women’s collectives that have come out onto the streets to make their voices heard and are protesting against the brutal injustices faced by the victim’s family.

The Legal Aid Clinic submitted a 22-page report to the Ministry of Environment highlighting inadequacies and seeking withdrawal of the Draft EIA Notification 2020.

The report is signed by 95+ Universities/Colleges, and the movement was co-ordinated by Yugma Network.

The Legal Aid Clinic of Jindal Global Law School along with College/University Clubs/ Unions & students across India, submitted a 22-page report to the Ministry of Environment, Forest and Climate, highlighting the inadequacies and seeking a withdrawal of the Draft EIA Notification, 2020. The proposed notification is a regressive departure from the 2006 version that it seeks to replace, it severely weakens environmental regulation & fails to create a balance between sustainable development and environment protection.

The report has been signed by 95+ Universities/Colleges (including Legal Aid Clinics of various National Law Universities & Law Colleges) and over 1740 students spread across India. We would like to thank 'The YUGMA Network' for coordinating the movement and making us a part of their network.

The Litigation Initiative Committee of the Legal Aid Clinic is organizing a Lecture Series on the broad topic of ‘Cruelty and Domestic Violence in India’.

We invite you to join in for the second lecture on ‘Recourse to Domestic Violence in India’ by Ms. Malvika Rajkotia, an attorney with about 32 years of experience in a wide range of practice areas. A legal stalwart in her profession, she is known as one of the country’s most successful divorce lawyers, having developed a primary focus on family and property law. She also takes up issues pertaining to civil liberties and environmental law and is also currently working up Delhi-based NGOs on human rights issues.
