*Preliminary issue - Issue of law not relating to jurisdiction of Court or a bar to suit created by any law for time being in force - Contention that issue of law has to be decided first, not tenable.

*Mutation - Mutation proceedings do not decide any right or interest of a party - Party can get his right declared in appropriate and regular forum and any such order passed by regular Court shall bind the parties.

*Maintenance petition - Dismissal in default - Family Court has power to recall and restore proceedings.
