Every brand is not just a name —

In Commercial Trademark Suit No. 1 of 2026,
Advocate Aman Shrotriya successfully argued the matter and secured an ex-parte ad-interim injunction in favour of Yayavar Luggage Pvt. Ltd., protecting their registered trademark “YAYAVAR.”

📌 What the Court Recognised:
✔️ Plaintiff’s prior use & statutory rights since 2020
✔️ Defendant’s attempt to ride on established goodwill
✔️ Strong likelihood of confusion and deception in the market
✔️ Risk of irreparable loss if protection was not granted

📌 Court’s Direction: The Defendant has been restrained from:
❌ Using the infringing mark “YAYAVAR”
❌ Passing off similar goods
❌ Exploiting the Plaintiff’s intellectual property
❌ Imitating identical or deceptively similar products
📌 Despite being duly served, the Defendant failed to appear, and the Hon’ble Court, after considering documentary evidence, granted timely protection to safeguard not just the brand — but also the consumer market from deception.
