Types of Bail under BNSS, 2023

"Bail is the rule, jail is the exception." Since the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 replaced the CrPC on 1 July 2024-

The types of bail:

✅ Regular Bail — Granted after arrest; for bailable offences (Sec 478) and non-bailable offences (Sec 480), read with Sec 483. Ensures the accused's presence during trial.
✅ Anticipatory Bail — Pre-arrest protection for a person apprehending arrest in a non-bailable offence (Sec 482, formerly CrPC 438). Applied before arrest.
✅ Interim Bail — Temporary relief till the regular/anticipatory bail plea is decided; prevents unnecessary detention. Judge-made (Articles 21 & 226).
✅ Transit Bail — Lets the accused travel from one place to another to seek regular bail from the appropriate court. Also judge-made, under courts' bail powers.
✅ Default (Statutory) Bail — An indefeasible right when investigation isn't completed in time. If the charge-sheet isn't filed within 60/90 days, the accused is entitled to bail (Sec 187(2)/(3)).
✅ Bail under Special Statutes — Governed by special laws with stricter conditions, e.g. NDPS Act, PMLA, UAPA.

Key factors courts weigh before granting bail:
✅ Nature & gravity of the offence
✅ Severity of punishment
✅ Possibility of absconding
✅ Risk of tampering with evidence
✅ Past criminal record

Remember: the purpose of bail is to secure the accused's presence, not to punish before trial — and conditions may be imposed while granting it.
