Most families assume only the builder is responsible if a redevelopment gets stuck. A recent Bombay High Court ruling says otherwise.
If the society shares in the gains of the redevelopment โ extra flats, money, or sale of extra space โ the law can treat it like a developer. It can then be made to refund buyers, with interest, alongside the builder. The reason: the society wasn't a passive landowner; it had a real commercial stake in the deal.

In a society planning redevelopment? Sharing the gains can mean sharing the responsibility โ get the agreement reviewed before signing.
