Highlights of Amendment in Indian Stamp Act, 1899

The Highlights of the same are as follows:
-Inserted certain definition such as allotment list, securities, debentures, market value
-Definition of instruments is broadened to provide for documents in electronic form or otherwise created for a transaction in a stock exchange or depository
-Stamp duty is levied on transfer of securities in demat form.
Stamp Duty is not applicable in case of Demat or Remat of Securities
-All the transactions (Issue, transfer of securities etc.) through stock exchanges and depositories are now under the purview of stamp duty in addition to issue/transfer of securities held physically.

Updates Ministry of MSME directed all companies having dues to MSMEs of more then 45 days to submit half yearly return with MCA showing such payments due and the cuause for delay of the same.

The Institute of Chartered Account of India and several other corporate bodies have also made representations to the ministry, requesting them to extend the period by another 15 days.

The ministry of corporate affairs (MCA) has deregistered about 50,000 companies in the last week as part of its ongoing drive against shell companies. The Delhi Registrar of Companies (RoC) has stuck off the names of more than 30,000 companies over the last three days, while more than 11,000 companies have been deregistered by the Mumbai RoC. Other RoCs have also struck off companies.

“These companies have been stuck off for not carrying any business or operations for the last two consecutive years. More such companies are likely to be stuck off in the next few days,” a senior government official said. “Notices of deregistration have been sent to all these companies,” he added. Last fiscal, the government had deregistered about 250,000 companies which had no operations or zero turnover for two consecutive years.
