"Social justice is not charityโ€”it is equality in action." โš–๏ธโœจ

Today we recognize World Day of Social Justice. Itโ€™s a reminder that true progress isn't found in hand-outs, but in building systems where everyone has the same seat at the table and the same protection under the law.

At Unique Law, we believe that justice should never be a privilege; itโ€™s a fundamental right. Letโ€™s move beyond awareness and toward action. ๐ŸคโœŠ

The Supreme Courtโ€™s decision to halt the UGC Equity Regulations has once again placed the question of equality, caste discrimination, and constitutional balance at the center of public discourse. Education is often described as the great equalizer, a space where merit, dignity, and opportunity should prevail without prejudice. Yet, the lived experiences of many students, teachers, and staff reveal that discriminationโ€”subtle or overtโ€”continues to exist within academic institutions.
The Courtโ€™s observation that unchecked intervention may โ€œdivide societyโ€ reflects a genuine concern for social harmony. However, harmony cannot be achieved by ignoring inequality. True unity is built when institutions acknowledge existing disparities and actively work to eliminate them, not when uncomfortable realities are pushed aside. The pause on these regulations raises critical questions: How do we ensure fairness without deepening social fault lines? How do we address caste-based discrimination while maintaining institutional neutrality?
UGCโ€™s Equity Regulations were introduced with the objective of creating inclusive and safe educational environments, ensuring accountability mechanisms against discrimination. Their suspension does not end the debateโ€”it intensifies it. It invites legal scrutiny on whether regulatory measures align with constitutional values, federal principles, and statutory limits. But beyond legality lies a moral responsibility. Constitutional ideals are not abstract concepts; they are promises made to real people whose access to education and dignity depends on their enforcement.
Education spaces shape future citizens, leaders, and lawmakers. If these spaces fail to address discrimination, the impact extends far beyond campuses. The Supreme Courtโ€™s role as the guardian of the Constitution requires balancing competing interestsโ€”individual rights, institutional autonomy, and societal cohesion.

Balancing the right to privacy involves understanding the interplay between the Right to be Forgotten and the Right to be Left Alone. The Right to be Forgotten empowers individuals to request the removal of personal data from online platforms, aiming to protect their digital reputation and personal history. On the other hand, the Right to be Left Alone defends against unwanted interference and intrusion into one's private life. Together, these rights emphasize the importance of personal autonomy and data protection in the digital age, urging legal systems and policymakers to adapt and respond to evolving privacy expectations and technological advancements.

The authors Namrata Ghosh and Soubhagya Khandual write about "Balancing Right to Privacy: The Intersection of the Right to be Forgotten and the Right to be Left Alone" with reference to important judgments such as R. Rajagopal v. State of Tamil Nadu, Jorawer Singh Mundy v. Union of India, Zulfiqar Ahman Khan v Quintillion Businessman Media Pvt. Ltd and X v. YouTube Channel.
