I speak to the Print on the powers of a third judge when it comes to hearing a criminal reference in appeal where two judges have given divergent opinion. Is section 392 of Crpc only limited to resolving the divergence of opinions, or does it mean something over and beyond?
The Supreme Court has questioned the correctness of the Sajjan Singh ruling and referred to a larger bench the issue of how far a third judge's powers extend in split-verdict appeals.
