Many families still say “We allowed her to work,” without realising how this makes a woman feel.
A married woman is an adult with her own dreams, just like everyone else in the family. She does not need permission. She needs support.

Indian law treats a husband and wife as equal adults.
Article 14 gives equality.
Article 21 gives personal liberty.
Article 19 gives her the right to choose her profession.

When her decisions are respected, she grows with confidence.
When the family supports her, she feels included and valued.

This is not about blaming anyone.
It is simply a reminder that support creates a stronger woman and a stronger family.

I recently came across a situation where a client’s entire case was affected because she couldn’t produce her original documents in court — and her advocate claimed he never received them.

🤔 Can a husband claim back the money his wife saved from household expenses?

The Supreme Court has made it clear — money given for family and personal expenses is a duty, not a loan.
If a wife saves from it, that shows her prudence and financial management, not misappropriation.

⚖️ Household savings = Cannot be claimed back
⚖️ Large assets/savings = May reduce alimony

The answer is No.
Under Indian law, every wife has the right to residence in her matrimonial home. She cannot be forced to vacate without a proper court order. The Domestic Violence Act further ensures that women are not rendered homeless during legal proceedings.

Many people believe divorce is not possible without a marriage certificate.
👉 The truth is, it’s not mandatory.

Courts only need proof that the marriage actually took place.
This proof can be through:
✔️ Wedding photos or videos
✔️ Invitation cards
✔️ ID proofs with spouse’s name
✔️ Witnesses who attended the wedding

⚖️ A marriage certificate is the best evidence, but divorce is still possible without it.

This question often sparks debate in family law. The purpose of maintenance is to ensure that a wife who cannot maintain herself is supported. But what happens when the wife is well-educated and capable of earning?

⚖️ Courts usually consider these factors:

Wife’s education, skills, and employability

Husband’s income, EMIs, dependent parents

The social status and lifestyle of both parties

👉 Recently, the Orissa High Court gave clarity. In one case, the wife was educated and had prior work experience but chose not to work. The trial court awarded her ₹8,000/month, but the High Court reduced it to ₹5,000, stating:

> “Law does not appreciate wives who remain idle despite being qualified, only to burden the husband.”

Takeaway: Maintenance is not about creating dependency. It is about balance — protecting the wife’s dignity while considering the husband’s financial responsibilities.
