A Curative Petition is the last and rarest legal remedy available before the Supreme Court of India.
After:
✅ Appeal is decided
✅ Review Petition is dismissed
A Curative Petition can be filed only in exceptional cases, such as:
• Gross miscarriage of justice
• Violation of natural justice
• Judicial bias
• Failure to provide a fair hearing
This remedy was introduced by the Supreme Court in the landmark Rupa Ashok Hurra (2002) case.
Important: A Curative Petition is not another appeal. It is entertained only in the rarest of rare cases to prevent injustice.
Justice may be final—but when exceptional injustice is shown, the law still keeps one last window open.
