The Hon'ble Tribunal upheld our argument on the liability of the Personal Guarantor arises only upon invocation of the Personal Guarantee, thereby holding that the Company Petition was filed within the period of limitation.

MDP Legal represented Axis Finance Ltd before the Hon’ble NCLT, Mumbai Bench, in a critical insolvency matter against Primat Infrapower and Multiventures Pvt. Ltd, an Essel Group company. The tribunal admitted Axis Finance’s plea to initiate corporate insolvency resolution proceedings for a default of ₹100 crore under Section 7 of the IBC.

This decision reinforces the protection of creditor rights and adherence to the Insolvency and Bankruptcy Code. We are proud to support Axis Finance in this significant matter. Devarajan Raman has been appointed as the interim resolution professional for the process.
