‘It is never too late to file a complaint’.
The earlier reported, the better the chances are of finding out the correct facts and evidence if applicable. However, a First Information Report (FIR) can be filed anytime with the local police station after such an incident has taken place. The police cannot refuse to file an FIR. If the police refuse, the Magistrate can be approached by making an application and the police authorities can be directed to take cognizance of the matter.
Firstly, one should note down what one has gone through and make their statement in detail so that the police officer is able to ascertain which sections are applicable to the crime. (See our article # The Law). The FIR is usually recorded in the local language of the place you lodge your FIR at. You have the right to ask for a translation of the same in Hindi or English and for it to be read out to you before you confirm the same.
Once an FIR is registered, the police are supposed to handle your case.
The steps taken by the police following an FIR are:-
• Investigation
• Arrest
• Chargesheet
• Court Hearing
• Sentencing
The chargesheet is to be filed within 60 days of filing the FIR after which the trial commences.

The MeToo movement has gained a lot of momentum in India recently, with
multiple women finally gaining the courage to come out and share their
experiences of sexual harassment. Now, more than ever before, it is
imperative that they are familiar with the law of the land and aware of their
rights to make their fight can be taken to its logical conclusion. It is
important that people have faith in the system. The amount of courage one
requires to make such a disclosure and recount the harrowing details of
such an incident is not only massive but takes a huge toll on both mental
and physical health. Often the victims tend to take the shame upon them,
the embarrassment is difficult to cast away and also the fear of further
humiliation results in them not taking any action. Taking steps to ensure
that the offender never dares to do such an act to anyone else, it is worth
fighting for.
