BIG RELIEF FOR HOME BUYERS & LEGAL HEIRS IN MUMBAI!

In a landmark order, the Deputy Registrar, Co-operative Societies, Mumbai, has declared a homebuyer as a “Deemed Member” after a housing society allegedly failed to decide the membership application for more than 11 YEARS!

The case involved Ketaki Co-operative Housing Society, where the applicant sought transfer of membership pursuant to a registered Gift Deed, but the society continued delaying the process citing internal family disputes.

📌 IMPORTANT OBSERVATIONS IN THE ORDER:

✅ Housing societies cannot keep membership applications pending indefinitely
✅ Failure to communicate decision within statutory timelines may result in “Deemed Membership”
✅ Internal family disputes are not valid grounds to arbitrarily withhold transfer
✅ Strong protection for flat purchasers, nominees & legal heirs
✅ Important interpretation of Sections 22 & 23 of the Maharashtra Co-operative Societies Act, 1960

The matter was argued by Adv. Sulaiman Bhimani along with Adv. Mitali before the Co-operative Authorities.

This judgment is expected to help thousands of flat purchasers and legal heirs facing arbitrary delays from housing societies across Maharashtra.

We feel deeply honoured and humbled that the landmark judgment secured by our team before the Maharashtra State Consumer Disputes Redressal Commission in favour of a senior citizen, who tragically lost vision in one eye after a cataract surgery, has been prominently featured by leading legal and mainstream media platforms — Law Trend and Free Press Journal.

This was not just a legal battle for compensation, but a fight for dignity, accountability, and justice for a 76-year-old woman who suffered irreversible loss of vision after undergoing cataract surgery at the age of 63 and waited over 13 years for justice.

The Hon’ble Maharashtra State Commission awarded compensation of ₹7 lakh, holding the ophthalmic surgeon liable for failing to disclose specific surgical risks in the consent form.

🚨 Breaking: Supreme Court Clarifies IBC Limitation Law

A major judgment under the Insolvency and Bankruptcy Code, 2016 that every homebuyer, investor, and creditor should know 👇

The Supreme Court of India has ruled that:

👉 Admission of a claim by a Resolution Professional (RP) during CIRP does NOT amount to acknowledgment of debt.

⚖️ What does this mean?
Simply put — you cannot use IBC proceedings to revive a time-barred claim.

💡 Why this matters:

✔ Limitation period under IBC remains strict
✔ RP’s role is administrative, not an admission of liability
✔ Delayed legal action can be fatal
✔ Big impact on cases before National Company Law Tribunal and National Company Law Appellate Tribunal

🏗️ For Homebuyers & Real Estate Investors

Even if you are treated as a financial creditor under IBC, delay in filing your claim can cost you your rights. This judgment makes one thing clear—timing is everything in law.

BIG WIN FOR CONSUMERS | STRICT 45-DAY RULE UPHELD
The Mumbai Consumer Forum has delivered a strong message —
⛔ Delay beyond 45 days will NOT be condoned.
In this important case, Adv. Sulaiman Bhimani, Founder & Managing Partner of The Law Suits, successfully represented 14 complainants and opposed the builder’s attempt to delay proceedings.
📌 The ruling reinforces that under the Consumer Protection Act, 2019, the timeline for filing a written statement is mandatory — not optional.
👉 This means:
✔ No unnecessary delays
✔ No misuse of legal process
✔ Faster justice for consumers
💬 Justice Delayed is Justice Denied — and the law stands firm on this principle.

Important Relief for Policyholders | Bombay High Court Judgment

The Bombay High Court has held that an insurance company cannot reject a genuine mediclaim reimbursement claim merely because it was filed late.

In this important case, the Court directed the insurer to reimburse the claim amount along with 6% interest, giving strong protection to consumers against unfair claim denials.

If your health insurance or mediclaim claim has been rejected on technical grounds, legal remedies may still be available.

Major Relief to Homebuyers | Landmark NCDRC Judgment
The National Consumer Disputes Redressal Commission (NCDRC) has taken a strong stand against defaulting builders, allowing coercive action for non-compliance of refund orders and observing that the corporate veil can be lifted in appropriate cases.
This ruling comes after repeated failure by the developer to refund homebuyers despite clear directions, reinforcing that consumer rights cannot be defeated by corporate structuring.
What makes this judgment significant:
✔ Strengthens enforcement under the Consumer Protection Act, 2019
✔ Sends a clear message to builders: Non-compliance = Consequences
✔ Opens the door for holding promoters and parent companies accountable
✔ A big win for homebuyers stuck in delayed projects
In fact, the Commission has even moved towards attachment of assets, freezing of bank accounts, and issuance of warrants, highlighting a shift from paper orders to real enforcement.
Key Takeaway:
Corporate structures cannot be used as a shield to escape liability—courts are now willing to look beyond the company to ensure justice.
