BIG RELIEF FOR HOME BUYERS & LEGAL HEIRS IN MUMBAI!
In a landmark order, the Deputy Registrar, Co-operative Societies, Mumbai, has declared a homebuyer as a “Deemed Member” after a housing society allegedly failed to decide the membership application for more than 11 YEARS!
The case involved Ketaki Co-operative Housing Society, where the applicant sought transfer of membership pursuant to a registered Gift Deed, but the society continued delaying the process citing internal family disputes.

📌 IMPORTANT OBSERVATIONS IN THE ORDER:
✅ Housing societies cannot keep membership applications pending indefinitely
✅ Failure to communicate decision within statutory timelines may result in “Deemed Membership”
✅ Internal family disputes are not valid grounds to arbitrarily withhold transfer
✅ Strong protection for flat purchasers, nominees & legal heirs
✅ Important interpretation of Sections 22 & 23 of the Maharashtra Co-operative Societies Act, 1960
The matter was argued by Adv. Sulaiman Bhimani along with Adv. Mitali before the Co-operative Authorities.
