Many people assume that a Notary Public and an Oath Commissioner perform the same functions. They donโ€™t. Although both use official stamps and signatures, their legal roles are distinct.

A Notary Public, appointed under the Notaries Act, 1952, authenticates identities, witnesses signatures, administers oaths, certifies copies (where permitted), and performs other notarial acts.

An Oath Commissioner, on the other hand, primarily administers oaths or affirmations and attests affidavits and declarations made on oath. Their role is limited to matters connected with sworn statements.

One of the most common misconceptions is that a notarized document automatically becomes legally valid or is conclusively proved in court. This is incorrect. A Notary or Oath Commissioner authenticates the ex*****on or attestation of a documentโ€”they do not certify that every statement contained in it is true. The legal validity and evidentiary value of a document depend on the applicable law, the facts of the case, and the evidence produced.
