Your marriage is personal. But protecting your legal rights is important too. βš–οΈ

A Marriage Certificate is more than just a document. It can serve as official proof of your marital relationship and play an important role in matters like home loans, spouse visas, tax benefits, banking, insurance claims, and property rights.

Many couples overlook marriage registration until they actually need the document.

This is why legal awareness mattersβ€”before a situation makes it necessary.

Can a wife demand any amount as maintenance or alimony from her husband? βš–οΈ

A woman can approach the court seeking maintenance for herself and her children. Under Section 144 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), the court may order maintenance where a husband, despite having sufficient means, neglects or refuses to maintain his wife or children.

However, asking for a particular amount does not automatically mean the court will grant the same amount.

The court considers various factors, including the income and financial condition of both spouses, reasonable needs, standard of living, and responsibilities towards children, before determining an appropriate maintenance amount.

If you are dealing with questions about maintenance, alimony, child support or women's legal rights in India, understanding your legal rights is an important first step towards protecting your future.

Can Parents Cancel a Court Marriage? Know What the Law Says. βš–οΈπŸ“œ

A common question many people ask is whether parents or family members can cancel a court marriage after it has been legally registered.

The simple answer is: No.

Under Indian law, a valid marriage between two consenting adults cannot be unilaterally cancelled by their parents merely because they disagree with the relationship or marriage.

Key Legal Points:

πŸ”Ή Special Marriage Act, 1954
A court marriage cannot be cancelled solely due to parental objection, family pressure, or disapproval.

πŸ”Ή Section 25 – Voidable Marriages / Annulment
A marriage may be annulled only by a competent court on legally recognised grounds, such as fraud, coercion, or other statutory reasons.

πŸ”Ή Family Opposition β‰  Legal Cancellation
Parents do not have the legal authority to independently cancel or invalidate a valid court marriage. Any challenge to the validity of a marriage must be addressed through the appropriate legal process before a competent court.

Remember: Once two adults legally marry with valid consent, their marital status cannot be cancelled simply because their family disagrees.

πŸ’¬ What do you think? Should parents have any right to challenge or cancel their adult children's court marriage? Share your views in the comments! πŸ‘‡

Can a son simply evict his elderly mother from the house and escape his legal responsibility? βš–οΈ

The law provides specific protections for parents and senior citizens under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

Under Sections 4 and 5, eligible parents and senior citizens can approach the Maintenance Tribunal for maintenance and support to meet their basic needs.

Further, where a senior citizen has transferred property subject to an obligation that the transferee will provide basic amenities and physical needs, and that obligation is subsequently not fulfilled, Section 23 may provide a remedy to seek a declaration that the transfer is void, subject to the facts and applicable legal requirements.

The Act also contains provisions relating to the abandonment of senior citizens. Section 24 may attract legal consequences where the statutory requirements are satisfied.

Therefore, abandoning or neglecting elderly parents is not merely a private family issue. Senior citizens have specific legal rights and remedies to protect their maintenance, dignity and well-being.

If you or someone in your family is facing such a situation, understanding the applicable legal remedies is an important first step.

Kya ek beta apni budhi maa ko ghar se nikaal kar apni legal responsibility se bach sakta hai? βš–οΈ

Maintenance and Welfare of Parents and Senior Citizens Act, 2007 ke under parents aur senior citizens ko important legal protection diya gaya hai.

Section 4 & Section 5 ke under parents/senior citizens Maintenance Tribunal ke saamne application dekar maintenance aur basic needs ki demand kar sakte hain.

Agar kisi senior citizen ne apni property is condition par transfer ki ho ki unki care aur basic needs ka dhyaan rakha jayega, lekin baad mein child care karne se mana kar deta hai, toh appropriate cases mein Section 23 ke under property transfer ko void karwane ki remedy available ho sakti hai.

Wahin, senior citizen ko jaan-boojhkar abandon karna bhi Section 24 ke scope mein legal action attract kar sakta hai.

Isliye parents ko unke haal par chhod dena sirf family matter nahi hai. Senior citizens ke rights aur protection ke liye law mein specific provisions available hain.

😳😭 Kya Government Employee Ka Video Record Karna Legal Hai? βš–οΈ

Agar koi Government Employee official duty ke dauraan aapke saath badtameezi karta hai, aapka legitimate kaam karne se mana karta hai ya improper behaviour karta hai, toh aap apne evidence ke liye us situation ko record kar sakte hain.

Article 19(1)(a) ke under Freedom of Speech and Expression ka Fundamental Right recognised hai, jisme information ko collect aur communicate karne ka aspect bhi included hai.

Lekin ek important baat: recording karte waqt Government Employee ki official duty mein kisi bhi tarah ka obstruction create nahi hona chahiye. Evidence preserve karein, lekin official work ko disturb na karein.

Agar aapko Government Office, Government Employee ya official work se related legal issue face ho raha hai, toh apne legal rights ko samajhna aur appropriate legal advice lena important hai.

Can your boss threaten to fire you just because you asked for leave? βš–οΈ

No, simply asking for leave does not automatically become a valid reason for termination.

If your establishment has 20 or more workers, the Industrial Relations Code, 2020 provides for a Grievance Redressal Committee where an individual grievance may be raised, subject to the applicable provisions.

If an employee is retrenched, Section 70 may provide for applicable requirements relating to notice or wages in lieu of notice and retrenchment compensation, depending on the circumstances.

πŸ“Œ Protect yourself:
Keep records of your leave application, WhatsApp chats, emails, notices and other relevant communication if you receive such threats.

Know your employee rights and labour law protections. The right information can help you take the right legal step.
