LIMITATION AFTER FILING APPLICATION u/s 33 of
A&C Act-
In National Highway Authority of India v. T. Younis & Anr. (decided June 2, 2026), the Supreme Court clarified that the limitation period to file a Section 34 challenge always begins from the date the Section 33 application is disposed of, whether the tribunal allows or rejects it.
This ensures a party's right to challenge the final award isn't prejudiced by pending tribunal corrections.
So, if you filed any application under section 33 and that application is allowed or rejected. Before filing application under 34, you should have a certified copy of final award after rejection of or allowed of Application under section 33 of Arbitration Act, then only you may get benefits of extension of limitation period means you must hv certified copy to show pendency of your application u/s33 n to show when it was disposed of.
