DAY 6 — Trademark Objection Does NOT Always Mean Your Trademark Is Rejected
Imagine receiving an email saying:
“Trademark Examination Report issued.”
The first reaction of many business owners is:
“My trademark has been rejected!”
But an examination report or objection should not automatically be treated as a final rejection.
The important question is:
“Why has the objection been raised?”
Trademark examination may raise issues based on the applicable legal grounds.
For example, an objection may relate to:
• Similarity with an existing mark
• Distinctiveness
• Classification of goods/services
• Descriptive nature of the mark
• Other statutory grounds
The correct response depends on the actual objection and the facts of the case.
Let's take an example.
Suppose you have filed a trademark for:
“NEXORA”
The Registry raises an objection citing a potentially similar earlier mark.
A business owner may immediately think:
“Someone already has this name. Everything is over.”
But that conclusion may be premature.
The relevant questions could include:
How similar are the marks?
Are the goods/services similar?
What is the nature of the earlier mark?
What are the facts surrounding the application?
What legal response is appropriate?
This is why a trademark objection should be read, understood and responded to carefully, rather than ignored.
One more important lesson:
Do not ignore official trademark communications.
Deadlines matter.
A timely and properly considered response can be extremely important in protecting your application.
So if your trademark receives an objection, don't panic.
Understand first.
Respond strategically.
