एक client मेरे पास आई जिसने अपने सबसे करीबी दोस्त को ₹5 लाख उधार दिए थे।
कोई कागज़ नहीं। कोई agreement नहीं। बस एक वादा और दस साल की दोस्ती पर भरोसा।
दो साल बाद वो दोस्त कह रहा था कि उसे कुछ याद नहीं।
कोई loan नहीं था। कोई deal नहीं थी। बस एक "gift" था उसकी नज़र में।
पैसे गए। दोस्ती गई। और अदालत में वो अकेली खड़ी थी बिना एक भी document के।
यही सच्चाई है।
हम सोचते हैं कि contract सिर्फ बड़े businessmen के लिए होता है। अजनबियों के लिए होता है। अपनों के साथ तो बस ज़बान काफी है।
लेकिन ज़बान अदालत में नहीं चलती।
WhatsApp message, email, यहाँ तक कि phone call पर हुई बात भी legally binding हो सकती है। और अगर वो भी नहीं है तो आपके पास कुछ नहीं बचता।
एक simple written agreement वो काम करती है जो रिश्ते नहीं कर सकते। वो हर बात को साफ रखती है। कौन क्या देगा। कब देगा। और क्या होगा अगर नहीं दिया।
यह अविश्वास की निशानी नहीं है। यह समझदारी की निशानी है।
अगर आप कोई deal कर रहे हैं, पैसे उधार दे रहे हैं, या किसी के साथ business शुरू कर रहे हैं तो एक बार ज़रूर सोचें। कागज़ पर लिखा हुआ वादा हमेशा ज़बानी वादे से मज़बूत होता है।
