Question :-
Is a loan recovery agent representing a bank or a
Non-Banking Financial Company permitted by law to visit a loan defaulter at his home or workplace or to contact them via phone calls?

Answer :-
In India, a loan recovery agent may visit the house of a defaulter. but RBI rules and court decisions put important restrictions on how they can behave. Banks and NBFCs remain responsible for the conduct of their recovery agents.

As per RBI 's guidelines and borrower protections include:

★1. Permissible timing of visits/calls:-
Recovery agents are generally allowed to contact or visit borrowers only between about 8:00 AM to 7:00 PM.

★2. No harassment or intimidation:-
Agents cannot:
* threaten arrest,
* use abusive language,
* use physical force,
* publicly shame the borrower,
* create nuisance in front of neighbours or family members.
RBI specifically discourages coercive and humiliating tactics.

★3. Identity and authorisation mandatory:-
Recovery agents should:

* carry official ID,
* show authorisation from the bank/NBFC,
* disclose the lender they represent.

★4. Privacy rights of borrower:-
Agents should not disclose loan details to neighbours, relatives, colleagues or society members merely to pressure the borrower.

★5. No illegal seizure of property:-
A recovery agent cannot simply take away property or vehicles by force unless due legal procedure is followed (for example under SARFAESI or court process, where applicable).

★6. Borrower may complain:-
If harassment occurs, the borrower may:

* complain to the bank/NBFC grievance cell,
* complain to RBI Ombudsman,
* approach police/court in serious intimidation or trespass cases.

The core legal position is this:
A lender has a right to recover lawful dues, but recovery must happen through lawful, dignified and non-coercive means. Even a defaulting borrower retains constitutional and legal protections.

The Chief Manager, Central Bank Of India v M/s Ad Bureau Advertising মামলায় মহামান্য সুপ্রীমকোর্ট ( Justice Mr. Sudhanshu Dhulia এবং Justice Mr.P.K.
"21. From an analysis of the aforementioned decisions, it is quite clear that what is to be seen here is that whether the dominant intention or dominant purpose for the transaction was to facilitate some kind of profit generation for the person who has availed the service. Therefore, it is our considered opinion that the respondent No.1 is not a ‘consumer’ in terms of Section 2 (1) (d) (ii) of the Act."

CIBL (credit information bureau)
মামলাও হয় ,ন্যাশনাল কনজিউমার ডিসপিউটস রেড্রেসাল কমিশন (NCDRC) ব্যাংকের পরিষেবায় ত্রুটি[ Deficiency of service, as defined under the Consumer Protection Act, 2019 (Section 2(11))] খুঁজে পান এবং ৭৫ লক্ষ টাকা ক্ষতিপূরণসহ মামলার খরচ প্রদানের নির্দেশ দেন সেন্ট্রাল ব্যাংক অফ ইন্ডিয়াকে।

★Police Cannot Arrest an Accused in a Complaint Case unless a Non-Bailable Warrant Is Issued: Supreme Court★

The Supreme Court has categorically held that the police have no authority to arrest an accused in a complaint case unless a non-bailable warrant (NBW) is issued by the competent court along with the process. The Court further clarified that even during the course of an inquiry under Section 202 of the Code of Criminal Procedure (Cr.P.C.), the police are not empowered to effect an arrest.

Yesterdat( 23 rd April 2026l the Apex Court highlighted a serious procedural irregularity prevailing in the States of Bihar and Jharkhand, where litigants are approaching the Sessions Court or the High Court seeking anticipatory bail in complaint cases under the apprehension that mere issuance of process would result in arrest.
The Court clarified that once cognizance is taken and process (summons) is issued, the accused is only required to appear before the concerned court and participate in the proceedings. Arrest does not automatically follow in such cases unless a non-bailable warrant is specifically issued to secure the presence of the accused.

A Bench comprising Justice J.B. Pardiwala and Justice Ujjal Bhuyan observed:
“Once the Court takes cognizance and issues summons, the accused is only required to appear and join the proceedings. There is no justification for approaching the Sessions Court or the High Court seeking anticipatory bail. The police have no authority to arrest in a complaint case unless a non-bailable warrant is issued by the Court along with the summons.”

The observation was made while adjudicating an appeal against the rejection of anticipatory bail by the Jharkhand High Court. The High Court had not only entertained and rejected the anticipatory bail application in a complaint case but also directed the appellant to surrender before the trial court, which led to the present appeal before the Supreme Court.
Disapproving the said direction, the Supreme Court held that requiring the accused to surrender and seek regular bail in a complaint case was without jurisdiction and reflected an erroneous application of law. The Court further noted that such practices compel litigants to approach the Apex Court unnecessarily.

“Anticipatory bail applications are being entertained unnecessarily and upon rejection, litigants are compelled to approach this Court. The direction to surrender and seek regular bail was wholly without jurisdiction,” the Bench observed. Arrest During Inquiry Under Section 202 Cr.P.C. The Court further elucidated that where a Magistrate, upon taking cognizance of a private complaint, postpones issuance of process and directs an inquiry under Section 202 Cr.P.C., even if such inquiry is entrusted to the police, it does not confer upon them the power to arrest the accused.
“Even when a Magistrate directs a police inquiry under Section 202 Cr.P.C., the police do not acquire the power to arrest the accused during such inquiry. The answer is an emphatic ‘No’.” No Power to Direct Surrender in Complaint Cases The Court also clarified the scope of jurisdiction of the Sessions Court and High Courts in such matters. While these courts may reject an application for anticipatory bail, they do not possess the authority to direct the accused to surrender.
“The Court may reject the anticipatory bail application; however, it has no jurisdiction to direct the petitioner to surrender.”
Directions Issued
In light of the above findings, the appeal was disposed of with a direction to the Registry to forward a copy of the order to the Registrar General of the High Courts of Bihar and Jharkhand, to be placed before the respective Hon’ble Chief Justices.

The global COVID-19 pandemic has had a prolonged and adverse impact on the lives of individuals worldwide, particularly due to the severe economic disruption it precipitated effects of which continue to persist. As a consequence of this financial distress, a significant number of individuals were reluctantly compelled to availed loans from banks, non-banking financial companies (NBFCs) and in many cases unregulated local moneylenders charging exorbitant rates of interest also.
In numerous instances, individuals who faced sudden unemployment or loss of income have been compelled to incur additional high-interest borrowings merely to repay existing equated monthly instalments (EMIs) on housing loans, vehicle loans or other financial liabilities. This cumulative debt burden has resulted in acute financial hardship and in certain cases, has driven borrowers towards extreme mental distress, even leading to suicidal ideation. However, such actions are neither a lawful nor a viable remedy.
While financial adversity is an unfortunate reality, it is not insurmountable. There exist structured legal remedies and financial restructuring mechanisms through which such debt-related crises may be effectively addressed. It is imperative to adopt prudent financial planning and seek competent legal advice to navigate and resolve such situations in accordance with applicable laws and regulatory frameworks.
