But the better question is, "What could this cost beyond money?"

"The Bombay High Court's decision in ONGC Ltd. v. Sapura Fabrication SDN BHD (Commercial Arbitration Petition No. 720 of 2024) draws a clear line between judicial review and appellate scrutiny in international commercial arbitration.

The Court held that a Section 34 petition is not an appeal on facts. If an arbitral tribunal has adopted a plausible interpretation of the contract, courts cannot reassess the merits simply because another view is possible.

Relying on Ssangyong Engineering & Construction Ltd. v. NHAI (2019), the Court further clarified that allegations of perversity cannot be brought under the "public policy of India" ground. The ground of patent illegality under Section 34(2A) is intentionally unavailable for international commercial arbitral awards.

Where an arbitral tribunal has adopted a plausible interpretation of the contract, judicial review must remain confined to the limited statutory grounds under Section 34(2), rather than a reassessment of the merits.
