Police Refusing to Register FIR in Kochi or Ernakulam?

Many people face delays or refusal when approaching the police to register an FIR — especially in financial disputes, property matters, cyber complaints, or assault cases.

However, when a cognizable offence is disclosed, registration of FIR is mandatory under law.

If an FIR is not registered, legal remedies are available, including:

• Complaint to the District Police Chief
• Petition before the Magistrate Court
• Appropriate legal action under BNSS

Understanding the correct legal steps at the initial stage can significantly impact the outcome of the case.

When a ₹2,70,000 cheque is returned “Funds Insufficient.”

A small business owner in Ernakulam approached our office after supplying goods worth ₹2,70,000 to a long-time business associate.

Payment was delayed.
Eventually, a cheque was issued.

Relief followed.

The cheque was deposited the next day.

Two days later, it was returned with the endorsement: “Funds Insufficient.”

Silence from the other side.
No response to calls or messages.

For many small and medium business owners in Kochi and Ernakulam, the hesitation is not about the amount alone.
It is about the relationship.

Common concerns we hear: • “What if the relationship gets spoiled?”
• “Maybe he will pay later.”
• “Is it worth going to court?”

Here is the legal position:

Dishonour of cheque for insufficiency of funds constitutes an offence under Section 138 of the Negotiable Instruments Act, subject to statutory compliance.

Timelines matter.
✔ Statutory notice must be issued within 30 days
✔ 15 days’ time is provided for payment
✔ Complaint must be filed within limitation

In this case, legal steps were initiated within time. Once proceedings commenced, discussions became more structured and serious.

Lesson for business owners:
Trust is good.
Documentation is better.
Timely legal action is essential.

If your business accepts cheques, do not ignore a dishonoured instrument. Delay can affect enforceability.
