भारत की आज़ादी के 73 साल गुज़रने, डिजीटल युग आने और तेज़ कम्प्यूनिकेशन के संसाधन के बाद भी किसी पुलिस थाने में एफ۔आई۔आर. (प्रथम सूचना रिपोर्ट) दर्ज कराना कतई आसान नहीं है।

1- पुलिस थाने पर जाने पर थाने के गेट पर, लंबी
छुरी लगी बंदूक लिये खड़े संतरी के सवालात
आपको अंदर नहीं जाने देगें।

2- आपके संतरी के समक्ष गिड़गिड़ाने पर उसका
जवाब होगा "अभी इंचार्ज साहब नहीं हैं बाद
में आना।" (जबकि एफ۔आई۔आर. दर्ज किये
जाने में थाना इंचार्ज का कोई रोल नहीं होता)
समय पूछे जाने पर जवाब-"शाम को आना।"
अगले किसी भी सवाल पर आपको अश्लील
गाली के साथ धक्के और झिड़की मिलेगी।
मतलब इंचार्ज से मिलना नामुमकिन है,
इसलिये रिपोर्ट भी नामुमकिन।

3- अब आज की घटना की रिपोर्ट अब डीसीपी/
एसपी को जरिये पंजीकृत डाक भेजने पर
10-12 दिन इंतज़ार कीजिये। इस दौरान यदि
चोरी हुई है तो सामान खुर्द बुर्द या फिर
मुल्जिम पुलिस की पहुंच से दूर। यानि
अपराधी मज़े में और फरियादी परेशान।

4- अधिकतर मामलों में डीसीपी/एसपी द्वारा
कोई कार्रवाई नहीं की जाती, तब अदालत में
इस्तगासा की कार्रवाई शुरू। अदालत 3 से 4
दिन में निहायत बारीकी से जांच, सवालात
और बहस सुनेगी। थाने में दी गई रिपोर्ट
फरियादी से मांगी जायेगी, फरियादी -"माई
लार्ड संतरी ने थाने में घुसने ही नहीं दिया तो
रिपोर्ट किसे देता।"
(मेरे एक मुकदमे में अदालत ने आदेश
दिया कि आपके मुवक्किल ने थाने में रिपोर्ट
नहीं दी। पहले रिपोर्ट दे कर आओ वर्ना
कार्यवाही खारिज। मैंने निवेदन किया कि
आप (मजिस्ट्रेट महोदय) और मैं बिना थाने
को सूचित किये, सिविल ड्रेस में फरियादी बन
कर थाने चलते हैं अगर संतरी ने आपको और
मुझे थाने में भी घुसने दिया तो आप मेरे
मुवक्किल की कार्यवाही खारिज कर देना।
इतना सुनते ही अदालत ने एफ۔आई۔आर.
दर्ज करने के आदेश जारी किए ।)

5- फिर अदालत आदेश पारित करेगी कि
"संबंधित थाने से इस संबंध में की गई
कार्यवाही की रिपोर्ट मंगवाई जाये।" अर्थात
10-12 दिन की तारीख़।

4- अब अदालत की इच्छा होगी तो ही रिपोर्ट दर्ज
करने के आदेश जारी होंगे। (जिसका आदेश
थाने पर 5-7 दिन में पहुंचता है ।) वर्ना
अदालत खुद जांच करेगी।
इस पूरी कार्यवाही में जबकि आप मुस्तैद
रहें हैं तो एफ۔आई۔आर. दर्ज करवाने में
आपको 30 से 35 दिन या इससे अधिक दिन
लेगेगें, आपको अथक प्रयास करने होगें और
समय और धन की आवश्यकता होगी।

5- इस आर्थिक, शारीरिक, मानसिक तनावपूर्ण,
निर॔तर श्रम के पश्चात अब आपका मुकाबला
पुलिसकर्मी से होगा, जो हर प्रश्न पर आपके
बयानों से आपकी घटना को संदिग्ध मानेगा।
इस सब खर्चीली और लंबी कार्यवाही की
अपेक्षा डाक से रिपोर्ट दर्ज करवाने की
सुविधा बहुत पहले शुरू की जानी चाहिये थी।
लेकिन अब इस फास्ट ट्रैक युग में तो तुरंत
प्रत्येक तीव्र संसाधन/स्रोत से एफआईआर
दर्ज होनी चाहिये। (असद ख़ान एडवोकेट)।
