A contract executed in India will be governed only by the provisions of the Indian Contract Act and other relevant Indian Laws even if the second party is of foreign origin. The laws of the country of origin / domicile of that person will not interfere with provisions of the Indian Laws in such cases even if performance of the contract, partly or fully, is made in country of that person.

This type of fraud involves a fraudster who collects the personal banking information of the victim and then approach the victim's mobile operator with fake ID proof to obtain a duplicate sim card. The mobile operator deactivates the original sim card and issues a replacement sim card. With the help of New sim card, the fraudster does the account transactions through the mobile banking without victim's knowledge.
