Borrower has no right to be heard in the proceedings under Section 14 of the SARFAESI Act.

Though a settled law, but Divisional Bench 1 of Indore HC has reiterated in WP No 906 of 2026 on 06.02.2026 that Borrower has no right to be heard in the proceedings under Section 14 of the SARFAESI Act. Proceedings under Section 14 SARFAESI Act are ministerial in nature and not quasi judicial in nature. S 14 proceedings before CJM/DM does not involve any adjudicatory process. Hence, Borrower cannot claim that principles of natural justice were not followed.

The Honble Madhya Pradesh High Court in Mradula Sisodiya v Ganesh Malakar and others MPHC Indore Bench in M.P. No. 3198/2024 has held:-

"Objection as to Lack of Pecuniary Jurisdiction cannot be allowed to be raised by the Judgement debtor under Section 47 of the Civil Procedure Code in ex*****on proceedings if no such objection was raised during the Trial. "

The Honble Court in its judgement has assessed and appreciated Section 21 of CPC along with Sections 15 to 20 of CPC. The Honble Court has also cited landmark Judgements of Harshad Chiman Lal Modi v. DLF Universal Ltd, 2005 (7) SCC 791, Harpal Singh v. Ashok Kumar and anr., (2018)11 SCC 113 and many other judgments and has explained which is provided in summary manner that if there is inherent subject matter jurisdiction then it can be interfered but if lack of territorial and pecuniary jurisdiction is shown, such objection should not be allowed unless prejudice is shown. The objection as to lack of jurisdiction should be raised at the earliest.

Serious Fraud Investigation Office v Aditya Sarda SLP (Cr.) No. 13956 of 2023

Brief of the case and issue:-

In Serious Fraud Investigation Office v Aditya Sarda SLP (Cr.) No. 13956 of 2023, Honble Supreme Court has again reiterated that an accused person, who is creating hindrances in the ex*****on of warrants or is absconding from trial proceedings, is not entitled to the privilege of anticipatory bail.

The Honble Supreme Court ( Honble Justice Bela Trivedi and Honble Justice PB Varale) observed:

"Granting anticipatory bail is certainly not the rule. The respondent accused, who have continuously avoided to follow the due process of law, by avoiding attendance in the Court, by concealing themselves and thereby attempting to derail the proceedings, would not be entitled to the anticipatory bail. If the Rule of Law is to prevail in the society, every person would have to abide by the law, respect the law and follow the due process of law."

The Honble Court further made following remarks as to the importance of judicial time of even Magistrate's Court and the duty od the accused to co-operate with the trial and about the related concept of administration of justice.

"It cannot be gainsaid that the judicial time of every court, even of Magistrate's Court is as precious and valuable as that of the High Courts and the Supreme Court. The accused are duty-bound to cooperate with the trial courts in proceeding further with the cases and bound to remain present in the Court as and when required by the Court. Not allowing the Courts to proceed further with the cases by avoiding ex*****on of summons or warrants, disobeying the orders of the Court, and trying to delay the proceedings by hook or crook, would certainly amount to interfering with and causing obstruction in the administration of justice."

The Honble Supreme Court as a consequence sets aside the order of anticipatory bail granted by the HC and asked the accused to surrender before the Special Court/ Trial Court which declared him the absconder under Section 82 of CrPC and directed the Special Court to decide the Bail application in accordance with law.

Note: Part 1 of this judgement deals with the core issue of this case as to the question of entitlement of the absconded accused to be released on anticipatory bail which has been briefed above .

Much needed as these youtubers/ youtube channels without having any understanding of Law and legal procedures tend to crop the videos to make clips of Court Hearings which lead to misinformation and incomplete information and generally are using thumbnails using defamatory words for the officers / people appearing in the Courts.

It shows a very wrong message to society that a particular section / department is scolded and not working but actually, in the Court room , the actual conditions are diffrent.

Every pillar of Government discharges it's duty by appearing before Court and the Honble Courts even if are passing directions are doing their duty as per the Constitution and law.and hence there is nothing to put glamour in this . The welcome step of Live streaming of proceedings was not meant for this .

It is the need of hour to pass strict directions to these channels to stop using wrong and defaming thumbnails and putting the result of the Judgement without even knowing as to what happened in the Court.

These clippings can be permitted only for educational purposes by coaching institutes or colleges to make them understand the practical aspects of law ( without using any thumbnail or caption) which will make the understanding of law students better.

This is the example how technology can be boon or prove to be bane

Honble Madhya Pradesh High Court Single Judge in WP No 12/2025 Shanti Bai Jarwal v Smt Manju Kumar and others has referred the matter to Honble Chief Justice of MPHC for constitution of a Larger Bench for deciding the question that :-
"Whether an appeal under Section 16 of the Maintenance and Welfare of Parents and Senior Citizens Act is maintainable at the instance of any senior citizen or a parent or it is maintainable at the instance of any aggrieved person "

The Question has been referred as the three judgments of the Coordinate Benches had divergent views. To have a clearer view, the matter has been referred.
