The High Court's decision on the extension of the period of an Agreement through written communication is truly groundbreaking. It is important to note that this ruling emphasizes that such an extension does not constitute novation, but rather keeps the Arbitration Clause operative and alive.

Our Partner, Mr. Nishant Nigam, and Associate, Mr. Aman Abbi, have secured a favourable order from the Delhi High Court in the Unique Décor (India) Pvt. Ltd. v. Synchronized Supply Systems Ltd. matter.

The bench comprising Justice Vibhu Bakhru and Justice Amit Mahajan observed that while signifying the importance of both Section 8 and Section 11 clarified the stance that such a situation would keep the arbitration clause alive. They emphasized a prima facie threshold for examining the existence of the agreement.
