Women Protection Council of India - मेरी Life Ngo (WPC India) Women in India-a better half of Indian society today are becoming the most vulnerable section as far as their safety and security is concerned.

The status of women in India has been subject to many great changes over the past few millennia.From equal status with men in ancient times through the low points of the medieval period, to the promotion of equal rights by many reformers, the history of women in India has been eventful. In modern India, women have held high offices in India including that of the President, Prime Minister, Speaker

of the Lok Sabha and Leader of the Opposition. our constitution
The Constitution of India guarantees to all Indian women equality (Article 14), no discrimination by the State (Article 15(1)), equality of opportunity (Article 16), and equal pay for equal work (Article 39(d)). In addition, it allows special provisions to be made by the State in favour of women and children (Article 15(3)), renounces practices derogatory to the dignity of women (Article 51(A) (e)), and also allows for provisions to be made by the State for securing just and humane conditions of work and for maternity relief. (Article 42)

Dowry Death under Bharatiya Nyaya Sanhita, 2023

• Dowry Death is the kind of heinous offence against the women under section 80 of Bharatiya Nyaya Sanhita, 2023 (herein called BNS-2023).

• Dowry Death means the death of women within seven years of marriage occure due to burn or bodily injury otherwise the normal circumstances soon before her death his subject to harrasment or cruelty by his husband and relatives for demanding dowry.

📌 As per the Section 80 of BNS, the main ingredients for committe the offence are as follows :-

a. Death within seven years of marriage

For the offence to be constituted under this section, the woman must have died within seven years of her marriage.

b. Death due to burns or bodily injury or occurring under unnatural circumstances

The cause of death must be burns, bodily injury, or other than under normal circumstances.

c. Cruelty or harassment soon before death

It must be shown that soon before her death, the woman was subjected to cruelty or harassment by her husband or his relatives for or in connection with dowry demands.

📌 This offence is triable by Court of Session and Imprisonment awarded not less than 7 years extended to life imprisonment.

📌 The presumption of Dowry Death under Bharatiya Sakshya Adhiniyam, 2023 is under Section 118 shall presume by the Court of law.

📌 In the case of 'Binda Prasad v. State of Madhya Pradesh, the Court held that that the cruelty and harrasment must done soon before the death of women.

85 of BNSS :-
Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine.

Non-providing of medical aid to wife constitutes cruelty u/S 498A of the IPC,

The High Court of Jharkhand upheld the conviction of the accused under Section 498A of the IPC after he refused to get her treated after she was diagnosed with cancer and held that the non-providing of proper medical aid to one’s wife to enforce the demand of dowry will come within the definition of cruelty as enunciated under Section 498A of the IPC.
