MCO Legals (Meharia & Company) is proud to have successfully represented Mumbai Port Trust Authority before the Hon’ble Supreme Court of India, challenging Bombay High Court’s judgment which had upheld National Commission for Scheduled Castes’ Order to grant consequential benefits and to pay arrears to an employee belonging to the Scheduled Caste category.
The Supreme Court clarified that the Commission does not possess adjudicatory powers under Article 338 of the Constitution and cannot issue binding directions in service matters - the Commission's role is recommendatory and advisory in nature, and not that of an adjudicatory body empowered to determine rights or grant enforceable relief.
The team before the Hon’ble Supreme Court was led by Mr. Amit Meharia, Managing Partner and assisted by Mr. Abinash Agarwal, Associate Partner and Mrs. Priya S. Bhalerao, Associate.
Arguments were advanced by Mrs. Rekha Palli, Senior Counsel.
