Can police keep shifting an accused from one state to another for investigation while he is already in jail? The Supreme Court recently heard gangster Lawrence Bishnoi’s plea challenging the repeated use of transit/PT warrants under Section 267 CrPC by Punjab, Haryana and Chandigarh Police. His counsel argued that Section 267 CrPC applies only during “inquiry or trial” and not for investigation, alleging that authorities kept extending custody by moving him across different states despite him already being lodged in another jail. The Supreme Court, however, observed that investigations in multiple FIRs cannot come to a halt just because an accused is already in custody elsewhere. Referring to a 2024 judgment, the Court clarified that investigating agencies can formally arrest a person already in custody and seek PT/transit warrants to produce the accused before the competent court for investigation and remand.
