⚖️ CALCUTTA HIGH COURT | IMPORTANT MAINTENANCE RULING

The Calcutta High Court has held that a father’s obligation to maintain a major child does not automatically cease upon attaining majority where the child is unable to maintain himself due to physical or mental abnormality.

The observation came in a case involving a son suffering from 70–75% orthopaedic disability.

Justice Uday Kumar, while dismissing the criminal revision petition, allowed the maintenance proceedings concerning the major child to continue.

⚖️ Jharkhand High Court | Important Family Law Update

The Jharkhand High Court has held that a wife’s mere wish for her husband to live as a “Gharjamai” cannot, by itself, constitute cruelty for the purpose of seeking divorce under Section 13(1)(ia) of the Hindu Marriage Act, 1955.

The Division Bench of Justice Sujit Narayan Prasad and Justice Sanjay Prasad considered an appeal challenging the dismissal of a divorce petition filed on the ground of cruelty.

🔹 Key takeaway: Differences in marital expectations, by themselves, do not necessarily amount to legal cruelty. The circumstances and overall conduct of the parties must be considered.

⚖️ Supreme Court Update | Widow’s Family Pension

The Supreme Court has held that a widow’s entitlement to family pension arises from the date of her husband’s death and cannot ordinarily be restricted merely to the date on which she approached the Central Administrative Tribunal (CAT), particularly where the delay was not attributable to her.

Defendant Need Not Enter the Witness Box to Prove an Admitted Document

The Hon’ble Supreme Court has held that where a defence is based upon an undisputed/admitted document already on record, the defendant is not necessarily required to step into the witness box to prove that fact.
