The Supreme Court's judgment in the Byjus case will provide much-needed clarity on the withdrawal of Corporate Insolvency Resolution Process (CIRP) post-commencement. As per Section 12A and Regulation 30A of the CIRP Regulations, prior to the formation of the Committee of Creditors (COC), the Interim Resolution Professional (IRP) may file a withdrawal application with the National Company Law Tribunal (NCLT) subject to certain conditions. However, appellate authorities have permitted withdrawals without adhering to the stipulated procedures in numerous cases. The Court has emphasized that once CIRP commences, it transcends a bilateral issue, necessitating the consideration of of all stakeholders before permitting withdrawal.
