🚨 Landmark Judgment | Workplace Sexual Harassment | MP High Court
In a powerful verdict, the Hon'ble Madhya Pradesh High Court (WP No. 5625/2020) held that a woman Yoga Instructor at LNIPE, Gwalior was subjected to sexual harassment by the then Vice-Chancellor. Despite multiple complaints, the institution failed to ensure a safe working environment. The Court acknowledged the violation of her fundamental rights under Articles 14, 19 & 21, and the provisions of the POSH Act, 2013 and Vishaka Guidelines.

The Hon’ble Court awarded ₹35 lakhs compensation against the perpetrator, ₹5 lakhs against the police for inaction, and ₹1 lakh penalty on the Institute for administrative failure. A bold reaffirmation that institutional apathy to gender injustice will not be tolerated.

📌 Right to dignity is non-negotiable. Safe workplaces are a legal mandate, not a privilege.

Daughters’ Property Rights: Supreme Court Sets the Record Straight—Again

In two important rulings, the Hon’ble Supreme Court has further clarified and strengthened the legal position of daughters with respect to ancestral property under Hindu law. These judgments decisively put to rest many outdated misconceptions still lingering in both legal practice and social understanding.

1. Vineeta Sharma v. Rakesh Sharma (2020)
This judgment reaffirmed that daughters are coparceners by birth, with rights equal to sons in Hindu joint family property. Crucially, the Court made it clear that this right does not depend on whether the father was alive at the time of the 2005 amendment.

Marriage has no bearing on a daughter’s coparcenary rights. She retains full entitlement to claim partition and exercise ownership, irrespective of her marital status.

2. Arunachala Gounder (Dead) by LRs. v. Ponnusamy & Ors. (2022, reaffirmed in 2025)
The Court held that once ancestral property is partitioned, the share allotted to each coparcener becomes their self-acquired property.
This means:

A daughter may deal with her share independently;

She does not require consent from siblings or other relatives to transfer, gift, or sell her portion.

This is a crucial clarification for property litigation. It preserves the individual autonomy of the coparcener and prevents unnecessary obstruction from other family members after partition.

As a practising advocate, I find these rulings not just legally sound but socially transformative. They equip us to enforce daughters’ rights with stronger footing—both inside and outside the courtroom.

Equality in inheritance is no longer aspirational. It is the law—and it must be enforced as such.
