दहेज केस में सुप्रीम कोर्ट का बड़ा फैसला

Supreme Court of India ने हाल ही में साफ कर दिया है कि सिर्फ पत्नी और उसके परिवार के बयान के आधार पर उन्हें “दहेज देने” के अपराध में आरोपी नहीं बनाया जा सकता।

👉 कोर्ट ने कहा कि Dowry Prohibition Act, 1961 की धारा 7(3) पीड़ित पक्ष को सुरक्षा देती है।
👉 यानी अगर पत्नी ने दहेज देने की बात कही है, तो उसी बयान के आधार पर उसके खिलाफ FIR नहीं हो सकती।

💡 यह फैसला दहेज कानून के सही इस्तेमाल और पीड़ित की सुरक्षा के लिए बेहद अहम है।

The Hon’ble Court granted bail after noting key factors:
The complainant was a mature and educated woman
She voluntarily travelled and booked the hotel
The relationship appeared consensual in nature
No criminal antecedents of the accused
Investigation substantially completed, no need for custody
The case highlights a crucial legal principle:
A failed relationship does not automatically amount to a criminal offence.
To attract Section 69 BNS, there must be clear dishonest intention from the very beginning, which was not evident here.

पाइप्ड नेचुरल गैस (PNG) उपभोक्ताओं के लिए घरेलू LPG सिलेंडर रखने पर रोक
केंद्र सरकार ने एक महत्वपूर्ण आदेश जारी करते हुए कहा है कि जिन घरों में पाइप्ड नेचुरल गैस (PNG) कनेक्शन उपलब्ध है, वे अब घरेलू LPG सिलेंडर का कनेक्शन नहीं रख सकेंगे और न ही उसका लाभ ले सकेंगे।
सरकार के अनुसार, जिन उपभोक्ताओं के पास पहले से PNG कनेक्शन है, उन्हें घरेलू LPG कनेक्शन सरेंडर (वापस) करना होगा। यह कदम संसाधनों के बेहतर उपयोग, सब्सिडी के दुरुपयोग को रोकने और गैस वितरण प्रणाली को सुव्यवस्थित करने के उद्देश्य से उठाया गया है।
यदि कोई उपभोक्ता PNG कनेक्शन होने के बावजूद घरेलू LPG सिलेंडर का उपयोग करता पाया जाता है, तो उसके विरुद्ध कार्रवाई की जा सकती है।

बिना पुलिस रिपोर्ट के शांति भंग की कार्यवाही नहीं! - इलाहाबाद हाईकोर्ट

हाल ही में Allahabad High Court ने एक महत्वपूर्ण फैसला देते हुए स्पष्ट किया कि शांति भंग (Peace Bond) की कार्यवाही में व्यक्ति को पुलिस रिपोर्ट और संबंधित दस्तावेज देना अनिवार्य है।

केस: Brijesh Kumar Singh vs State of U.P. and Others

मामले में एसडीएम द्वारा Bharatiya Nagarik Suraksha Sanhita, 2023 की धारा 126/130 BNSS के तहत नोटिस जारी कर व्यक्ति से ₹1,00,000 का पर्सनल बॉन्ड और दो जमानतदार देने को कहा गया था।

लेकिन समस्या यह थी कि नोटिस के साथ पुलिस रिपोर्ट की कॉपी नहीं दी गई, जिसके आधार पर यह कार्रवाई शुरू की गई थी।

न्यायमूर्ति Justice Dinesh Pathak ने कहा:

✔ जिस आधार पर कार्यवाही शुरू की गई है उसकी पुलिस रिपोर्ट और दस्तावेज आरोपी को देना जरूरी है
✔ तभी वह सही तरीके से अपना जवाब दाखिल कर सकता है
✔ बिना दस्तावेज दिए कार्यवाही करना प्राकृतिक न्याय के सिद्धांत के खिलाफ है

📌 कोर्ट ने आदेश दिया:
• 15 दिनों के भीतर पुलिस रिपोर्ट उपलब्ध कराई जाए
• उसके बाद आरोपी को जवाब दाखिल करने का अवसर दिया जाए
• तब तक कोई coercive action नहीं लिया जाएगा

यह फैसला महत्वपूर्ण है क्योंकि कई बार शांति भंग की कार्यवाही को निजी विवादों में दबाव बनाने के लिए इस्तेमाल किया जाता है।

प्रथागत तलाक (Customary Divorce) का दावा केवल कथन से नहीं, बल्कि ठोस साक्ष्य से सिद्ध होना आवश्यक है।”

Delhi High Court ने Smt. Sushma vs Sh. Rattan Deep & Anr (28 नवंबर 2025) में यह स्पष्ट किया कि यदि कोई व्यक्ति यह दावा करता है कि उसका पूर्व विवाह समुदाय की प्रथा (custom) के अनुसार पंचायत द्वारा समाप्त हुआ था, तो उसे उस प्रथा के अस्तित्व और वैधता को मजबूत साक्ष्यों से साबित करना होगा।

केवल एक आपसी समझौता (agreement) या कुछ गवाहों के बयान से प्रथागत तलाक सिद्ध नहीं माना जाएगा।

यदि पूर्व विवाह विधिक रूप से समाप्त नहीं हुआ है, तो बाद में किया गया विवाह **Hindu Marriage Act, 1955 की धारा 5(i) के उल्लंघन में माना जाएगा और वह विवाह धारा 11 के तहत शून्य (Void) घोषित किया जा सकता है।

कानूनी निष्कर्ष:
Customary divorce एक अपवाद है, इसलिए इसे सिद्ध करने का भारी दायित्व उसी व्यक्ति पर होता है जो इसका दावा करता है।

भारत में पुलिस हिरासत में पारदर्शिता और जवाबदेही सुनिश्चित करने के लिए Supreme Court of India ने एक महत्वपूर्ण फैसला दिया।

सुप्रीम कोर्ट के प्रमुख निर्देश:
-->सभी पुलिस स्टेशनों में CCTV कैमरे लगाना अनिवार्य
-->लॉकअप, पूछताछ कक्ष, प्रवेश और निकास स्थान कवर होंगे
--> CCTV फुटेज कम से कम 18 महीने तक सुरक्षित रखी जाएगी

Landmark Supreme Court Ruling on Maintenance in Void Marriages

In Sukhdev Singh v. Sukhbir Kaur (2025 INSC 197), the Supreme Court of India clarified an important issue under the Hindu Marriage Act, 1955.

Even if a marriage is declared void under Section 11, the spouse can still claim maintenance and permanent alimony under Sections 24 and 25 of the Act.

The Court held that the phrase “any decree” in Section 25 includes a decree declaring a marriage void. Therefore, a financially dependent spouse cannot be left destitute merely because the marriage is held invalid.

The Court also emphasised that maintenance is discretionary and depends on the facts, financial condition, and conduct of the parties.

Another important observation:
The Court strongly criticised the use of terms like “illegitimate wife” or “faithful mistress”, calling such language misogynistic and contrary to the dignity guaranteed under the Constitution.

The Supreme Court laid down important guidelines on when criminal proceedings can be quashed and clarified that if an FIR discloses a cognizable offence, the police must register the case and investigate.
