⚖️ Maintenance Ignored… Marriage Ended by Supreme Court ➡️⚖️
A wife obtained a maintenance order of ₹80,000 per month for herself and her two children, along with school expenses. But the husband repeatedly defaulted, filed multiple proceedings, and even failed to honour undertakings given before the High Court. Due to continuous non-compliance, the Family Court struck off his defence and dismissed his own cases. Despite this, the wife had to initiate repeated ex*****on proceedings to recover arrears.
The matter ultimately reached the Supreme Court. The Court found that the husband had turned litigation into a tool of harassment, filing multiple cases even against the wife’s lawyers. It held that such conduct was oppressive and that the wife’s actions for the safety and welfare of the children could not be termed malicious.
Invoking Article 142 of the Constitution, the Supreme Court held that the marriage had irretrievably broken down, dissolved the marriage, closed all pending proceedings, granted custody of the children to the wife with visitation rights to the husband, and directed payment of ₹5 crore as full and final settlement.
