The government has recently come up with a new e-form INC 22A which is also known as e-Form ACTIVE (Active Company Tagging Identities and Verification).
Every Company incorporated on or before 31st December, 2017 shall file the particulars of the Company and its registered office in e-form ACTIVE.
Due Date: On or before 25th April, 2019
Who cannot file the above form?
Companies which have not filed Financial Statements or Annual Return or both (Exception: Companies under Management dispute)
Companies which have been struck off
Companies which are under the process of Striking off;
Companies under Amalgamation or Liquidation
Companies which are dissolved;
Company failing to file the above form shall be marked as “Active – Non-Compliant” in the MCA Master data and such a company will not be able to do the following transactions: -
SH-7 (Change in Authorized Capital)
PAS-3 (Change in Paid-Up Capital)
DIR-12 (Changes in Director except cessation)
INC-22 (Change in Registered Office)
INC-28 (Amalgamation /Demerger)
Fees: Upto 25th April, 2019 – No Government Fees
After 25th April, 2019- Additional Fee of Rs. 10,000/-
Attachments: Two Photograph of the registered office of the company. The first photo of the registered office shall be taken from outside of the premises, whereas the second photo needs to be taken from within the registered office premises showing at least one director / KMP who shall be signing the e-form INC-22A.To be digitally signed by one director in case of OPC. In case company other than OPC, form shall be signed by one director and one KMP or two directors.
