Aegis Legal has completed it’s 10 years of litigation & ADR Practice. We started the Firm in 2016, from its principal office at Defence Colony, New Delhi, India. In last 10 years, we have served more than 1000 clients of across India, Dubai, Qatar, UK & USA..

We have filed petitions before almost all High Courts across India, except High Court of J&K.
Also, More than 200 SLPs have been filed from our office in last 10 years..

The Supreme Court, in its recent judgment in SBI General Insurance Co. Ltd. Vs. Krish Spinning, has comprehensively explained the scope and standard of judicial scrutiny while adjudicating an application under section 11 of the Arbitration and Conciliation Act, 1996. The Court retraced the existing jurisprudence on the scope of interference under section 11 of the Act to further restrict the scope afforded to courts while referring disputes to arbitration.

The Supreme Court remoulds the existing jurisprudence on Section 11 of Arbitration Act, by limiting the scope of examination at the referral stage to only the prima facie existence of an arbitration agreement.

Recently, Constitutional Bench of the Hon’ble Supreme Court led by CJI Sanjiv Khanna comprising Justices BR Gavai,Sanjay Kumar, AG Masih and KV Viswanathan has held that Article 142 can be used to modify arbitral awards. However, Justice KV Viswanathan dissented on the issue. The Court held that such a power needs to be utilized in order to ensure that the parties are not stuck in cycle of prolonged litigation.
