Can a Court order a retrial after a judgment has already been delivered? In criminal cases, a retrial is not ordered merely because a party is dissatisfied with the judgment. Under the old Section 386(b) CrPC, and now Section 427 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, an Appellate Court has the power to order a retrial in appropriate cases.

The Supreme Court has repeatedly clarified that retrial/de novo trial is an exceptional remedy, generally justified where serious illegality, procedural irregularity, denial of a fair trial, or a grave failure of justice has occurred. It cannot be used routinely to fill gaps in the prosecution's case.

Under Section 6 of the Hindu Succession Act, 1956, daughters have the same coparcenary rights as sons in Mitakshara joint Hindu family property. However, the legal position regarding self-acquired property is different, particularly during the lifetime of the owner.

A Karta of a Hindu Joint Family has special powers in limited circumstances:
ЁЯФ╣ LEGAL NECESSITY тАФ Property may be dealt with to meet genuine family needs, such as necessary debts, maintenance, medical expenses, taxes or other legally recognised necessities.
ЁЯФ╣ BENEFIT OF THE ESTATE тАФ Action may be taken to protect, preserve or improve the family estate or prevent substantial loss or deterioration.
ЁЯФ╣ INDISPENSABLE DUTY тАФ Certain essential family or religious obligations may justify dealing with joint family property.

These powers are not unlimited. The transaction must be legally justified and connected with the recognised grounds under Hindu law. The Supreme Court has repeatedly recognised that a Karta can alienate joint family property for legal necessity or benefit of the estate, subject to the applicable legal requirements.

A co-ownerтАЩs right in ancestral or joint family property does not automatically disappear merely because the property has not yet been partitioned. An undivided co-owner may continue to hold a legal share in the property, subject to the applicable personal law and the nature of the property. In appropriate circumstances, an undivided share can also be transferred without first obtaining a physical partition. However, such a transfer generally relates to the transferorтАЩs undivided share and does not automatically give the transferee exclusive ownership of a specific portion of the property. This video explains the Supreme Court position, property rights, undivided shares, family property, and the importance of partition.

Order 7 Rule 11 of the Code of Civil Procedure (CPC) deals with the rejection of a plaint at the initial stage of a civil suit. A plaint may be rejected in specific circumstances, such as where it does not disclose a cause of action, the relief is undervalued and the defect is not corrected, the suit is barred by law, or the plaint is not properly filed in accordance with the applicable requirements.

In this video, we discuss the latest Supreme Court approach in 2026 regarding Order 7 Rule 11 CPC, particularly whether a civil case can be dismissed merely by pointing out defects or deficiencies in documents. The video explains the important legal principles, the scope of the court's power at the stage of Order 7 Rule 11, and what litigants and advocates should understand before seeking rejection of a plaint.

For VIP Whats App Group ( Call 8252-8252-82 ) joining Fees 1 year - 1000 Rs

When a person dies and their property passes to the next generation through legal succession, the property does not automatically become ancestral property merely because it has been inherited from a parent or grandparent. The nature and source of the property are important. Similarly, if the names of multiple family members are jointly recorded in the property documents, it does not automatically make the property HUF property. In such circumstances, the parties may hold the property as co-owners, with each person having an undivided share according to their legal entitlement. In this video, we explain the latest judgments and landmark principles concerning ancestral property, succession, co-ownership and HUF property in 2026.

The Supreme Court of India has issued important clarifications and guidelines on limitation periods under the Limitation Act, 1963, through various recent judgements. This video covers:
Introduction (0:00 - 1:30 approx.)
Key provisions of the Limitation Act, 1963 and how limitation periods work for different types of cases (e.g., 3 years for contract breaches, 12 years for property possession suits, 30-90 days for appeals).

Recent Supreme Court judgements (2025 onwards) clarifying limitation rules, such as:
Strict approach to condoning delays (e.g., entire delay period must be properly explained; no condonation based solely on merits of the case).

Computation rules, including exclusions and starting points (e.g., from date of knowledge/awareness or pronouncement).
Key cases on delay condonation in commercial appeals and tribunals.
Understand the latest Supreme Court stance on time bars to avoid your case being dismissed as time-barred!
