Clarification on Delhi Police Statement Regarding Gazette Notification dated 13.08.2025
1. Authority to Issue/Withdraw Gazette Notifications
The notification dated 13 August 2025 was issued by the Government of NCT of Delhi.
As per law, only the issuing authority (GNCTD) or a superior authority (Ministry of Home Affairs, Government of India) has the power to withdraw, amend, or rescind a Gazette Notification.
2. Status of the PRO Statement
The statement issued by the PRO, Delhi Police does not amount to a withdrawal or suspension of the notification.
A PRO or even the Commissioner of Police does not have statutory competence to alter a Gazette Notification.
At best, it reflects an administrative assurance that the notification’s operation will be kept in abeyance until stakeholders are heard.
3. Legal Position
Unless a formal rescinding/withdrawal notification is published in the Gazette, the earlier notification of 13.08.2025 continues to hold the force of law.
Courts and authorities are bound by the Gazette Notification until it is legally withdrawn.
4. Implication for the Bar
The Delhi Police statement should be seen only as an interim operational pause, not a legal withdrawal.
The Bar must press for a formal notification of withdrawal/amendment from the Government of NCT of Delhi / Union Ministry of Home Affairs.
Conclusion: The Delhi Police PRO has no power to withdraw the notification. Only the GNCTD or Union MHA can legally rescind it through a fresh Gazette Notification.
