However, she can seek permanent alimony as a Divorce Settlement, compensation under Domestic Violence Act or interim maintenance under Code of Criminal Procedure while the case is pending.

To determine the amount of alimony, compensation, or interim maintenance, your net worth is crucial.

However, this calculation excludes your parents' net worth and assets, which is often deliberately calculated as part of your personal net worth by the wife’s side to increase the amount sought.

Supreme Court Raises Concern Over Misuse of POCSO Act in Personal Disputes
The Supreme Court has expressed serious concern over the increasing number of false and frivolous cases being filed under the Protection of Children from Sexual Offences (POCSO) Act in the backdrop of matrimonial conflicts and other personal disputes.
The Court observed that the misuse of stringent criminal provisions not only causes immense hardship, mental trauma, and reputational damage to innocent individuals but also undermines the very purpose of the law, which is intended to protect children from sexual offences. Such false allegations place an unnecessary burden on the criminal justice system, consume valuable judicial time, and divert attention from genuine victims seeking justice.
Emphasizing the need for careful scrutiny of complaints, the Supreme Court cautioned against the weaponization of criminal law for settling personal scores and stressed that legal provisions must be invoked responsibly and in good faith. The Court reiterated that while protecting children remains paramount, safeguards must also be ensured to prevent the abuse of legal processes and to protect innocent persons from unwarranted prosecution.
