IMPORTANT JUDGEMENT

NI ACT Section 138 Dishonour of Cheque Bank Account frozen by the Income Tax Department —Whether the petitioners can be held liable under Section 138 when the cheque was dishonored due to the account being frozen by the IT Department — The petitioners argued that the dishonor was beyond their control as the account was blocked by the IT Department, and thus, they should not be held liable under Section 138 of the NI Act — The respondents contended that the disputed facts should be resolved during the trial and not through a petition under Section 482 of the CrPC — The court quashed the complaint and the consequential proceedings, ruling that the petitioners could not be held liable under Section 138 of the NI Act due to the account being blocked by the IT Department — The court emphasized that for an account to be maintained, the account holder must be able to operate it — Since the account was blocked, it could not be considered as maintained by the petitioners.
