The Chief Minister Advocate Welfare Group Mediclaim Scheme for the period from 16.05.2026 to 15.05.2027 is presently under the process of renewal. All existing advocate members shall continue to remain covered under the current policy, and therefore there is no requirement to submit a fresh application at this stage.

Any updated information, notifications, or further instructions regarding the scheme shall be made available on the official websites of the [Bar Council of Delhi](https://delhibarcouncil.com/?utm_source=chatgpt.com) and [CMAWS Delhi Law Department](https://cmaws.delhi.gov.in/?utm_source=chatgpt.com), and the same shall also be communicated through the registered email IDs of the members.

Freedom of speech is a constitutional right, but hate speech, threats, abuse, defamation, and targeted harassment online are not protected under law.

📚 WHAT LAW SAYS?

• Article 19(1)(a) gives freedom of speech
• But Article 19(2) allows reasonable restrictions in the interest of public order, decency, morality, defamation, etc.

Relevant legal provisions include:

• Section 153A IPC/BNS – Promoting enmity between groups
• Section 295A IPC/BNS – Deliberate acts hurting religious sentiments
• Section 499 & 500 IPC/BNS – Defamation
• IT Act provisions relating to harmful electronic content

⚖️ IMPORTANT JUDGMENT:

Shreya Singhal v. Union of India

The Supreme Court struck down Section 66A of the IT Act for being unconstitutional, but also clarified that speech inciting violence, hatred, or public disorder is not protected.

POV:
Being anonymous online does not mean being above the law.

The Bar Council of India (BCI) has taken a stand against the Andhra Pradesh High Court for sending a young advocate to 24-hour judicial custody. The reason? Alleged "indolent behavior."

The Legal Stand:

Article 21: Detention without due process violates personal liberty.

The Law: Advocates are officers of the Court, not subordinates.

SC Precedent: In In Re: Arundhati Roy (2002), the Supreme Court ruled that judicial power must be used with "caution and moderation," not as a tool for intimidation.

What may feel like freedom of expression can actually become a legal offence.
Under Indian law, such content can attract serious consequences, including:

IT Act, 2000 (Section 67, 67A) – Punishment for publishing/transmitting obscene or sexually explicit material online

IPC Sections 292–294 – Obscenity laws

POCSO Act – Zero tolerance if minors are involved (even unintentionally)

Digital footprint – Once online, it’s permanent and traceable
