1872 में प्रिवी काउंसिल ने The General Manager of the Raja Durbhunga vs Maharaja Compartido Ramapur Sing मामले कहा था - ' भारत मे वादकारी की वास्तविक दिक्कत शुरू होती है वाद में डिक्री प्राप्त करने के बाद उसको निष्पादित करने में।'
अप्रैल 2021 में माननीय उच्चतम न्यायालय ने Rahul Shah vs Jitendra Kr. Gandhi मामले में इजराय वादों के निष्पादन में हो रही देरी पर अपनी चिंता जताई और प्रभावी उपाय न होने तक वैकल्पिक उपाय सुझाये है।
जो बातें अदालतों को 1872 में पता थी वो आज भी वही है..✍️

Every lawyer should learn one year civil law. Go to city civil court. Go to the small causes court - that's where the real India is. Then, do one year of criminal law. See what's bail, anticipatory bail, what's trial. Learn the basics of CPC and CrPC and then you do your specialisation. All lawyers must first consider grounding themselves in the basics of civil and criminal law. There's no point going straightway into the air conditioned rooms of the Supreme Court. That's always my belief. Read biographies, take notes. There is so much to learn from biographies.
Don't be in a hurry. The future is very good. The younger generation is much, much brighter..✍️

Law is not a money-making racket. Law is a profession ,not a trading business. Lawyers don’t retire, they practice till they die. My only advice to young lawyers is to choose a stream of practice or even profession which interests you to continue till that time, don’t think of just making money out of it.
But today the trend is to treat law as a commercial activity. This is not a business. This is not about demand and supply.
I often tell young lawyers, if you think you will come here (in profession) and make money, then you are in the wrong place, go and do import-export or become builder, that is more lucrative monetarily..✍️

मुझे लगता है National Court of Appeal के मुद्दे पर हमे एक बार फिर से विचार करना चाहिए। न्याय की पहुंच आम जन तक हो इस नजरिये से भी यदि देखा जाये तो भी इसकी जरूरत है। सुप्रीम कोर्ट सिर्फ संवैधानिक मुद्दों पर सुनवाई करे एवं अन्य मामलो हेतु सुप्रीम कोर्ट की अपील बेंच सुनवाई करे। देश के हर भाग से आकर दिल्ली में मामलो की सुनवाई व्यवहारिक रूप से सही संकल्पना नही है। इसलिए भी जरूरी है देश के अलग – अलग हिस्सों में सुप्रीम कोर्ट की बेंच की स्थापना की जाये।

अगर देश के अलग हिस्सों में National Court of Appeal की स्थापना की जाये तो जो सबसे अहम सुधार आयेगा वो ये की न्याय की गुणवत्ता में सुधार आयेगा। अभी जो दिल्ली और मुंबई की और अन्य मेट्रोपोलिटन शहरो की जो मोनोपोली है वह टूटेगी एवं देश के अलग अलग हिस्सों में युवाओ की प्रतिभाये निखर कर सामने आयेंगी। इन बेंचो में काम आने से देश के हर हिस्से में युवा न्यायिक क्षेत्र में अपनी प्रतिभा निखर सकेगा। उसे दिल्ली आने की जरुरत नही है. वादकारियो को भी इसका लाभ मिलेगा और सुप्रीम कोर्ट पर भी दबाव कम होगा क्यूंकि उसे अब सिर्फ संवैधानिक मामले देखने होंगे। युवा प्रतिभाओ के हित में भी यह एक महत्वपूर्ण फैसला होगा।

उदाहरण के लिए अगर आप सर्विस मामले देखे तो हर मामले में संवैधानिक व्याख्या से जुड़े प्रश्न नही होते है। ऐसे मामलो की संख्या काफी कम होती है। इसलिए में National Court of Appeal की क्षेत्रीय बेंच होने से ये मामले वही निपटाए जा सकेंगे।

दूसरा पक्ष अगर देखे तो हमारे यहाँ Law Commission की रिपोर्ट को सरकारे अहमियत नही देती। कमीशन की 265 रिपोर्टो में से अभी तक मुश्किल से 90 रिपोर्ट पर सरकारो ने संज्ञान लिया होगा। ऐसे में सिर्फ रिपोर्ट प्रस्तुत करने से तो काम नही होने वाला। इसके लिए हमे इस प्रक्रिया में सुधार करना होगा। आज न्याय का क्षेत्र काफी विस्तृत हो गया है। उसे देखते हुए यह सुधर करना पड़ेगा कि Law Commission की रिपोर्ट को implement करना बाध्य हो। Law Commission में दो अलग Wing की स्थापना करनी होगी जिनमे एक Legal Reform Wing होगी तथा दूसरी Court Reform & Restructuring Infrastructure Wing होगी। जिनके सदस्यों में हर क्षेत्र के प्रोफेशनल, प्रबंधन, आदि को सम्मलित किया जाये। जो सामाजिक, आर्थिक, एवं अन्य आधारों के आधार पर समय समय पर अपनी रिपोर्ट दे जिसे सरकारे लागू करे। साथ ही कोर्ट के संसाधनों एवं जरूरतों को देखते हुए उनके बुनियादी सुधार करे। जैसे अमेरिका ने 1971 में अपनी फेडरल कोर्ट में बदलाव कर किया।

एक Legal Research Wing भी होनी चाहिए हो जिसमे सभी राज्यों से विधि कॉलेज को भूमिका दी जाये एवं राज्य अधिनयम का निर्माण करने में इनकी एक भूमिका हो जिससे कि हमारे युवाओं को भी आम लोगो के साथ अपनी भागीदारी निभाने का मौका मिले।

अभी अलग – अलग राज्यों में High Court की न्यायिक अधिकारिता को लेकर अलग अलग अधिनियम चलन में है कुछ में आजादी से पहले के नियम है तो कुछ में बाद के। अभी एकरूपता नही है। इनमे एकरूपता आये इसके लिए एक Universal National High Court Jurisdiction एक्ट की जरूरत है।

न्यायालयों में पारदर्शिता बढे, आंकड़ो में स्पष्टता हो एवं प्रोफेशनल तरीके से काम को बढ़ावा मिले इसके लिए Judicial Council एक अच्छा मॉडल है। California Judicial Council एक नजीर है। सारी जानकारी उपलब्ध है। एक साधारण व्यक्ति भी अपने मामलो की न्यायिक प्रक्रिया को समझ सकता है। क्यूंकि जो व्यक्ति न्याय के लिए आया है हमे सुधार करते वक्त उस व्यक्ति के हित को ही प्राथमिकता देनी है। दुर्भाग्य से अभी हमारी अदालते न्याय का प्रतीक नही बन पाई है। अब इन सुधारो की ओर बढ़ना जरूरी हो गया है।
