Are you running behind dishonoured cheques?

Are you confused about what happens after bouncing of cheques?

Here are few words from JK about how you should deal with bounced cheque!

Once a cheque has been dishonoured, the bank will return the cheque to the cheque holder along with a return memo explaining the reason for the dishonour. Within 30 days from the date of the return memo, a legal notice must be issued, demanding the payment of the amount due. Once the defaulter has received the legal notice, they have 15 days to make the payment for the cheque.

If the defaulter fails to pay within 15 days, after the expiration of the 15th day specified on the notice, the cheque holder must file a criminal Complaint in a magistrate's court within 30 days after the expiry of the time specified in the notice.
These procedures need to be followed in a timely manner to ensure that the cheque bearer can legally hold the defaulter accountable. If the procedures are not followed, the complainant will lose their right to initiate a criminal prosecution. In cases of criminal proceedings, it is very important to keep track of the limitation period.
