GST on RWA Maintenance Charges – Can crossing ₹7,500 make the entire amount taxable?
A significant judgment of the Madras High Court in Greenwood Owners Association & Ors. v. Union of India & Ors. provides an important principle on the interpretation of GST exemption notifications.

🔹 Issue before the Court
Entry 77(c) of Notification No. 12/2017-CT (Rate) provided exemption to contributions made by members to an RWA “up to” ₹7,500 per month per member.
The AAR and CBIC Circular No. 109/28/2019-GST had taken the view that if the contribution exceeded ₹7,500, the entire contribution would become taxable.

For example:
➡️ Monthly contribution = ₹9,000
➡️ Department's interpretation = GST on ₹9,000
➡️ RWA's contention = GST only on ₹1,500

The Court adopted a literal interpretation of the expression “up to”.
It held that:
✅ Contribution up to ₹7,500 per month per member continues to enjoy exemption.
✅ Only the amount exceeding ₹7,500 is liable to GST.
❌ Crossing the ₹7,500 threshold does not automatically make the entire contribution taxable.
Accordingly, the Court quashed the contrary interpretation contained in the AAR ruling and the relevant portion of Circular No. 109/28/2019-GST.

This judgment is an excellent illustration of the importance of the actual language used in an exemption notification.
Where the notification says “up to” a specified amount, the Court found that the exemption extends up to that ceiling, with only the excess becoming taxable.

Aadik Theopane Lenin scores his 2nd IM norm. The 14-year-old youngster from Kerala went to Hungary to play in the Budapest One week August A GM norm Round Robin. He won 2 games and drew 7 out of 9 and with 5.5/9 scored his 2nd IM norm.

Aadik scored 2 wins against FM Rithvik Krishnan (2369) and IM Antoine Bournel (2411).

Aadik played amazing chess in two tournaments in India - Gujarat GM in Ahmedabad and KIIT GM in Bhubaneshwar and gained 264 Elo points. After this, Subha Rakesh, a chess promoter in Kerala organized a fundraiser for Aadik where they raised close to Rs.4 lakh through different sources to fund Aadik's Europe trip. This 2nd norm is a result of this support.

Speaking to ChessBase India, Aadik's father said "I have no words to express my gratitude. Aadik has secured his 2nd IM Norm in the Budapest GM Round Robin Tournament. Thank you so much for the kind support, encouragement, and blessings of so many people. It means a lot to us."

Aadik is now 2392 on the FIDE live rating list. We wish him the best for his final IM norm and hitting 2400 to become India's latest IM! 😍

Edition Date: 28.05.2026

🔷 Income Tax Return Filing Season

Assessment Year 2026-27 க்கான Income Tax Return Filing Season தற்போது முழுமையாக தொடங்கியுள்ளது.

Self Occupied Property, Let Out Property

[Income Tax e-Filing Portal Downloads Page](https://www.incometax.gov.in/iec/foportal/downloads/income-tax-returns?utm_source=chatgpt.com)

Due Date

Professional Advice

AIS Based Verification, Automated Scrutiny

🚫 No Overreach Without Evidence!

“Do not label someone guilty without proving the offence!”

GST administration is not merely a revenue collection mechanism; it is a system that must function on a careful balance of legal discipline, fairness, and administrative accountability. At its core lies the doctrine of Natural Justice, particularly the principle of “presumption of innocence.” In simple terms, no taxpayer should be treated as guilty without credible and verifiable evidence. However, in practice, this foundational principle is increasingly being diluted, which raises serious concerns for both compliance and governance.

📌 Actions Without Evidence – A Structural Concern

Modern GST enforcement is heavily reliant on data-driven scrutiny. Tools such as GSTN analytics, third-party integrations, and AI-based risk flags are used to identify suspicious patterns. While these tools are useful for risk identification, they are merely indicators, not conclusive evidence.

In practice, however, these indicators are often treated as final proof, leading to immediate and sometimes harsh actions such as issuance of notices, blocking of Input Tax Credit (ITC), or even freezing of bank accounts. Particularly in cases involving supplier defaults or return mismatches, even genuine transactions risk being labelled as “bogus.”

This leads to a fundamental legal flaw: “suspicion is treated as proof.” Such an approach is inconsistent with any sound legal framework and undermines the credibility of the system.

⚖️ Natural Justice – A Mandatory Procedural Safeguard

Natural Justice is not a theoretical concept; it is a binding procedural requirement in any adjudication process.

The principle of “Audi Alteram Partem” (hear the other side) mandates three essential safeguards in GST proceedings:

• There must be a clear and recorded “reason to believe” before initiating action
• The taxpayer must be provided with all relevant allegations and supporting documents
• A meaningful and effective opportunity of being heard must be ensured

In many instances, vague Show Cause Notices (SCNs), template-based allegations, and pre-determined conclusions violate these safeguards. As a result, the adjudication process risks becoming a mere formality rather than a fair evaluation.

📉 Impact on Taxpayers – Financial and Systemic Risks

Unsubstantiated allegations are not just compliance issues; they create systemic risks for taxpayers.

• Immediate disruption of working capital due to ITC blockage or bank account freezes
• Threat to business continuity and operational stability
• Reputational damage affecting relationships with vendors, customers, and financial institutions
• Increased litigation costs and compliance burden

Most importantly, such actions create a trust deficit. The success of a tax system is not measured solely by enforcement strength, but by the level of trust it commands among taxpayers.

🛡️ The Way Forward – Aligning Enforcement with Fairness

Addressing these challenges requires more than incremental improvements; it calls for structural reform.

Standardization of evidence thresholds – Enforcement actions must be based on defined evidentiary standards, ensuring that suspicion alone does not trigger punitive measures.

Pre-notice consultation mechanism – Before issuing a Show Cause Notice, a structured opportunity should be provided for taxpayers to explain discrepancies, thereby reducing unnecessary litigation.

Reasoned orders and accountability – Every order must clearly articulate the reasoning behind conclusions. There should also be accountability for actions taken without adequate evidence.

Technology with human oversight – While AI and analytics are valuable tools, final decisions must involve human judgment. “Automation without application of mind” must be strictly avoided.

🔍 Conclusion – From Slogan to Systemic Reform

“Do not label someone guilty without proving the offence” is not just a slogan; it reflects a constitutional ethos that must guide tax administration. For GST to evolve from a compliance-driven regime to a trust-based ecosystem, this principle must be actively upheld in practice.

Unfair enforcement may yield short-term revenue gains, but it ultimately erodes long-term compliance and credibility. In contrast, a system built on fairness, transparency, and evidence-based decision-making ensures sustainable tax governance.

Ultimately, a strong tax system must be rooted in a strong principle:
👉 “No action without evidence; no taxation without justice.”
