Piracy of Design refers to when the copyright vested in a registered design is unauthorized used or duplicated for commercial purpose.
Section 22 (2) outlines the remedies available in case of such piracy which includes a fine not exceeding 25,000/- as Contract Debt.
In the alternative the aggrieved party may also elect to institute a suit for damages and injunction thereof before the Court of a District Judge.

Trademark Dilution refers to when someone unauthorizedly uses a well known trademark in a manner which leads to reducing the distinctiveness of the said mark and/or impacts its reputation adversely.
Section 29 (4), Trademark Act outlines that in case the infringer adopts and uses in trade a mark which is identical or similar and uses it for different kind of services/products the same may be deemed infringement due to "dilution".
The Delhi High Court declared "Bukhara" as a "well-known trademark" noting the "Indian legal position" and the "enormous fame and goodwill" enjoyed by the restaurant evidenced from the documents placed on record.

Miramax V. Tarantino : The Pulp Fiction NFT Saga
In 1993, American filmmaker, Quentin Tarantino, entertainment studio Miramax, LLC, and Tarantinoโs production company Visiona Romantica, Inc., entered into a series of agreements relating to the production and financing of the popular 1994 film, PULP FICTION. Tarantino granted to Miramax all rights and also copyright of the film. In 2021 Tarantino launched an NFT collection consisting of images of some portions of the filmโs screenplay which led to a copyright and trademark infringement suit by Miramax against Tarantino.
The case revolves around whether Tarantinoโs reserved right to โscreenplay publicationโ encompasses Tarantinoโs right to launch the NFT collection. Tarantino has been asked to produce all documents and communications pertaining to his IP rights in Pulp Fiction, while the case is still pending.
A dispute over IP rights to Pulp Fiction-related NFTs demonstrates why practitioners need to enhance their clientsโ portfolio registrations with fresh applications to cover this new asset.
What Is The Minimum Capital Required To Start A Private Limited Company?
A private limited company is required to maintain a minimum paid-up capital of Rs. 1 lakh. However, this amount could be higher, as prescribed by the MCA from time to time.
Last month, CCPA had issued guidelines stating that restaurants and hotels levying of service charges in the bill would be voluntary and optional and no consumer shall be forced to pay the same.
However, in a recent petition filed by National Restaurants Association of India, the High Court of Delhi has stayed the effect of the abovesaid guidelines while observing that the issue whether imposition of service charge can be treated as unfair trade practice within the ambit of the Consumer Protection Act, 2019 requires detailed consideration.
The Court stayed the guidelines subject to the conditions that the members of the petitioner Association shall ensure that the proposed levy of a service charge in addition to the price and taxes payable and the obligation of customers to pay the same is prominently displayed on the menu or other places.
